Two Nebraska families are being reminded of an expensive lesson this back-to-school season: teach your kids your own values, and the state makes you pay. Nebraska requires parents to educate their kids, but reserves funding solely for families who enroll in public school and subsequently accept the government's teaching philosophy.

Education is speech. The curriculum, books, and values reinforced in the classroom all carry a message. The Constitution says parents, not the government, get to direct it. The price tag on a full private-school education in Nebraska can be over $100,000. Apparently, that’s the going rate for raising your kids with their best interest in mind. A constitutional right shouldn't come with that kind of penalty.

NCLA has filed Jacobsen v. Spellerberg on behalf of two Nebraska families: Nebraska doesn't get to mandate educational speech then penalize you if you disagree with its educational messaging. That's textbook viewpoint discrimination, and an unconstitutional condition on a public benefit.

The District Court heard oral arguments in the Lincoln weapons preemption case today.

This case challenges a sweeping gun ban imposed by Mayor Leirion Gaylor Baird in response to the enactment of LB 77, which included both statewide permitless carry and preemption of local gun control ordinances.

Dick Clark, an attorney and legislative staffer representing himself on Friday, also opposed the bill. He said LB 1088 would add unnecessary duties for law enforcement and noted that prohibited persons are already banned from possessing fi****ms under Nebraska law.

Clark argued LB 1088 would instill a stricter policy than federal law, which calls for the surrender of fi****ms only after the final order of a domestic abuse case has been made. He said the bill is well-intentioned, but he doubts it would actually accomplish Raybould’s goal of preventing violence.

“If they’re willing to kill, they’re probably willing to be a liar,” Clark said.

Nebraska lawmakers considered a slate of bills Friday aimed at improving protections for victims of domestic violence.
