What is Estate Administration?

Estate Administration is the process of clearing a deceased person’s name off of record ownership and transferring wealth/assets to legal heirs/named beneficiaries.

Estate Administration By Survivor Joint Owner: Oftentimes, a surviving spouse or joint owner will be the only heir of a person’s estate. This is either because the spouse co-owned an asset with the right of survivorship or because an account/real property is held in joint tenancy. Upon the death of an owner, the joint owner need only to present a death certificate to the financial institution to clear the deceased person’s name off of the title.

Estate Administration by Small Value: California law states that if a person dies with less than $166,250 in personal non-real estate assets, those assets can pass by Will or intestate succession without the need for formal probate. (Cal. Probate Code Section 13100 et.seq.) If a person dies with real estate in his/her name, and such real estate has been appraised by a probate referee at an amount which is less than $166,250 total with the deceased person’s other
non-real estate assets, then the estate can be administered by a summary court proceeding which is shorter and likely less costly than formal probate.

BE AWARE WHEN WRITING YOUR OWN ESTATE PLAN

According to a recent Wall Street Journal opinion piece, it's easy to create your own estate planning documents.

We review self-prepared documents with some regularity as part of our practice. The article is right... it IS easy to prepare your own documents BUT it is even easier to:

1. MISINTERPRET and/or misunderstand legal terms of art and their significance in your plan. What is "issue"? What are "heirs at law"? What does "by right of representation mean"? How is the law of your state interpreting these terms?

2. Sign without observing legal formalities, thereby creating an INVALID and inoperative document. What needs to be notarized? What needs to be witnessed? How many witnesses? Who can be witnesses?

3. Inadvertently FORGET to include certain people or include language explaining why they are not included - thereby increasing the chances of litigation after you die.

4. Forget to address all parts of a document that are impacted by a change in another place in the document, thereby creating MULTIPLE POSSIBLE INTERPRETATIONS and questions about your intent. Those questions are going to be resolved by legal action and can really harm sensitive family dynamics.

5. Use language that is UNCLEAR or vague because you aren't trained in drafting these types of legal documents.

6. Create more legal PROBLEMS upon your death by failing to consider all of the issues associated with minor beneficiaries.

7. FAIL to appreciate the role of each separate document, their importance and relevance in your specific case.

8. Fail to appreciate the various income, property and estate TAX implications potentially involved in your estate.

It's very tempting in today's world to be seduced by the idea of doing it yourself. But the truth is that while some - very few - people could probably prepare their own documents just fine, MOST would be creating more problems than solutions.

COVID-19 has estate planning on a lot of people’s minds. We continue to serve clients at this time, with measures in place for getting documents created and signed legally and with social distancing maintained as much as possible. We care that people do things properly because we get paid a lot more to clean these messes up after the fact than we would have been paid to do them properly in the first place.

When administering an estate it never hurts to check for unclaimed property, but you don’t have to be deceased to have a claim. If you go into the CA Controllers Office website and search unclaimed property you might find money that has been turned over to the State and may belong to you. If it sits unclaimed for too long, it will be forfeited. Happy searching!
