When I ask many small business owners why they haven't trademarked their business name and brands, I always get the answer, " I have an LLC. Isn't that the same thing?" NO. They are not the same. An LLC does not protect your brand from infringers of your business and brand. Not having a trademark for your business is setting yourself up for future litigation! Imagine you one day receive a cease and desist letter for using the name of your business that someone else now has a registered trademark. This can be financially devastating to your business because if you decide to fight, trademark litigation costs are upwards of $100,000! If you decide to change your name, you will then have to pay to have everything changed and lose that brand recognition with your consumers.
