Melinda K. Mendes, Attorney at Law, LLLC is re-opened for Business! After almost 2 years dedicating my time working with clients of the State of Hawaii Office of the Public Defender on Kauai, I have rejoined the private sector. I am once again available to assist the needs of anyone charged with any type of criminal offense, including OVUII/DUI, as well as handling ADLRO and TRO hearings.

Lihue, Hawaii- On January 11, 2018, the day of my Client B.C.’s scheduled Bench Trial (a trial before a Judge instead of a jury) for the charges of Terroristic Threatening in the Second Degree; Harassment; and Disorderly Conduct, the State orally moved to dismiss my Client B.C.’s case with prejudice. The Judge granted the motion and all of the charges were dismissed with prejudice.

Lihue, Hawaii- On January 8, 2018, my Client M.B.’s Felony Abuse of Family and Household Members; Robbery in the Second Degree; and Theft in the Third Degree charges were DISMISSED WITH PREJUDICE. On December 28, 2017, near the scheduled trial date the State filed a Motion to Dismiss my Client M.B.’s charges without prejudice (meaning the State could refile the charges). At the hearing, I successfully argued for the dismissal of all the charges to be with prejudice (meaning the charges can never be refiled by the State).

Lihue, Hawaii- On the January 8, 2018, scheduled Jury Trial date, the State moved to dismiss with prejudice my Client K.B.’s Violation of Order of Protection and Unauthorized Entry into a Motor Vehicle in the Second Degree charges. The Court granted the oral motion and the case was dismissed with prejudice.

Līhu‘e, Hawaii- MOTION TO DISMISS TWO FELONY COUNTS and MOTION TO REDUCE BAIL GRANTED. On December 5, 2017, a Circuit Court Judge granted my written Motion to Dismiss the two Class C felony Reckless Endangering in the First Degree counts in a case against my Client M.J. The Court then granted my written Motion to Reduce my Client M.J.’s Bail from $5,000 down to $1,000 (allowing $4,000 of the cash bail posted to be returned now). I successfully argued that the State did not have probable cause to charge those offenses in this case.

Līhu‘e, Hawaii-NOT GUILTY FINDING IN BENCH TRIAL for a Duty Upon Accident Involving Property Damage charge. On December 1, 2017, a Judge dismissed the decriminalized citation against my Client O.A., after a trial in District Court.
