Twenty years ago today, a tragedy like none other changed countless lives in our community and our state forever when Comair Flight 5191 crashed just after takeoff, taking the lives of every person on board other than the co-pilot who was at the controls. It was the honor of a lifetime, and a heady responsibility, for the lawyers in our firm to represent the families of several of those passengers, seeking justice for beautiful lives lost, all of them in their prime.

If you have a moment today, take a stroll through UK’s Arboretum and pause at the Flight 5191 Memorial, imagining each of the doves taking flight, as so many souls did that day. And remember that in the midst of an unimaginable tragedy, our community rose to the occasion. Two decades later, we still feel the loss of each person on board, but we also know that commercial aviation is safer because of the changes made after the crash, and our community is stronger for the bonds that were formed in its wake. May God bless each soul who was on that airplane, and the many loved ones who were left behind to mourn an unnecessary and nearly inconceivable loss.

“Kentucky has a long history of trusting the ordinary people who sit on juries to make important decisions using all of the facts in front of them,” Prather said. “Immunity bills are the legislature’s attempt to substitute their own judgment for the judgment of juries.”

Our co-counsel, David Garrison, will argue at the Kentucky Supreme Court at 11:00 am today on behalf of our clients in Held, et al. v. Hitachi Automotive Systems, Inc. The key issue is how Kentucky will apply its Wages & Hours Act in light of the U.S. Supreme Court's recent decision in Helix Energy v. Hewitt. The Court will decide whether the trial court prematurely dismissed the unpaid overtime claims of our class of supervisors at a Madison Co. manufacturing plant. As always, you can watch the arguments live online or on KET-KY.

Issues include: (1) proper "salary basis" analysis for KWHA claims given recent decision in Helix Energy Sols. Grp., Inc. v. Hewitt, 598 U.S. 39 (2023), which addresses virtually identical provisions contained in the Fair Labor Standards Act ("FLSA"), 29 U.S.C. §201 et seq.; (2) whether employees a...
