The United States Court of Appeals for the Sixth Circuit has unanimously affirmed the dismissal of all claims against a Kentucky Sheriff in a federal civil rights lawsuit arising from a vehicle pursuit and arrest.

The Sixth Circuit upheld the district court's grant of summary judgment and held that our client was entitled to qualified immunity. The plaintiff alleged that the officers used excessive force during his arrest and asserted related state law claims. The Court rejected those claims, concluding that our client’s actions were objectively reasonable under the circumstances and affirming the dismissal of the case in its entirety.

This result reflects the efforts of Scott Miller, Tyler Chelf, Emily Bertram Pence, and the entire L.S. Miller Law team throughout the litigation and appeal. The Sixth Circuit's decision brings this matter to a successful conclusion for our clients.

The Sixth Circuit upheld the district court's grant of summary judgment obtained in May 2025. On appeal, the plaintiff challenged the officers' actions under the Fourth Amendment and asserted claims involving excessive force, excessive show of force, municipal liability, and related state law theories. The Court affirmed the dismissal of all claims.

We are proud of this result and grateful for the hard work of our team throughout this litigation and appeal. The Sixth Circuit's decision brings this matter to a successful conclusion for our clients.
