The goal is to "make the plaintiff whole" by restoring them to the same financial and emotional state they were in before the accident occurred. Damages are typically broken down into three categories:
1. Economic Damages
***tangible, out-of-pocket
financial losses resulting from
the injury: medical expenses,
lost wages, loss of earning
capacity, property damage.
2. Non-Economic Damages
***intangible, subjective losses
that negatively impact quality
of life: pain & suffering,
emotional distress,
disfigurement.
3. Punitive Damages
***not meant to compensate the
victim. Instead, awarded to
punish the defendant and
deter others from engaging in
similar reckless, intentional or
egregious behavior.
