A federal judge ruled today that USCIS acted unlawfully when it froze green card, work permit, and citizenship applications for people from 39 countries last November. These were people who filed the right paperwork, paid the fees, showed up to their interviews, and did everything they were supposed to do. Their cases were frozen anyway.

Today the court said enough.

On May 22nd, USCIS issued a memo saying green cards inside the U.S. should only be approved in exceptional circumstances. These two were approved on May 28th and May 30th, with no extra evidence requested to satisfy that standard.

Green card approvals within the U.S. are still happening.

Update: USCIS issued a memo last week that sent everyone into a panic, and now DHS is walking it back, saying it was never a blanket rule and that officers have always had this discretion. Which raises a fair question: what was the point? Even officers on the ground did not have clear guidance on what this memo meant. That means field offices are operating with little to no direction right now, so not everyone is being asked the same questions. If you have a pending case or an upcoming interview, come prepared for anything.

Continuando con el memo de USCIS que compartimos la semana pasada.

Si solicitaste tu residencia sin salir de los Estados Unidos, los oficiales ahora tienen instrucciones de cuestionar si debiste haber hecho el proceso en el consulado de tu país. Y ya lo están preguntando en las entrevistas.

Para muchas personas, salir a hacer el proceso consular no es tan sencillo. Si en algún momento estuviste sin estatus migratorio en los Estados Unidos, salir del país podría activar un castigo de 3 o 10 años que te impediría regresar por años.

Personas están reportando preguntas como:

🔹 ¿Por qué solicitó su residencia aquí en lugar de hacerlo en el consulado en su país?
🔹 ¿Sabía usted que esa era una opción?
🔹 ¿Hay alguna razón por la que no pudo hacer el proceso allá?
🔹 Si se quedó más tiempo del permitido, ¿por qué solicitó desde aquí en lugar de salir y hacerlo en el consulado?
🔹 ¿Todavía tiene familia en su país de origen?
🔹 ¿Por qué se quedó en los Estados Unidos después de que su visa o permiso de estadía venció?

Following up on the USCIS memo we shared last week.

If you applied for your green card without leaving the U.S., officers are now being told to question whether you should have gone through the process at a U.S. consulate in your home country instead. And they are already asking about it at interviews.

For many people, leaving to do the consulate process is not a simple option. If you have unlawful presence in your U.S. history, leaving the country could trigger a 3 or 10 year bar that keeps you outside the U.S. for years.

People are reporting questions like:

🔹 Why did you apply for your green card here instead of going through the consulate in your home country?
🔹 Did you even know that was an option?
🔹 Is there any reason you could not have done the process there?
🔹 If you overstayed your visa, why did you apply from inside the U.S. instead of leaving and doing it abroad?
🔹 Do you still have family in your home country?
🔹 Why did you stay in the U.S. after your visa or authorized stay ended?

Under this new policy, officers have to document exactly why they approved your case. Your answers need to be thoughtful and consistent.

If you have an interview coming up, please do not walk in unprepared.
