Here’s a clear, IRS-based summary of the rules (with citations) for claiming dependents in shared physical custody situations — including 50/50 splits — where more than one parent is eligible to claim a child. 1) Only one taxpayer may claim a child
• The IRS does not allow both parents to claim the same dependent or split dependent tax benefits on separate returns. Only one parent can claim the child as a dependent and receive related tax benefits each year.

2) “Custodial parent” defined by nights lived
• The IRS defines the custodial parent as the parent with whom the child lived for more nights during the year based on actual physical presence.
• If the child lived with both parents an equal number of nights, the IRS uses a tie-breaker: the parent with the higher adjusted gross income (AGI) is treated as the custodial parent for claiming purposes.

3) What happens in a true 50/50 custody year? (Equal nights)
• Even if custody is exactly 50/50, for IRS purposes someone must be treated as custodial under the tie-breaker rule:
o Tie-breaker: Parent with the higher AGI for the year “wins” the right to claim the child if actual physical custody is equal.
• A noncustodial parent (the one who didn’t have more nights) may still claim the child as a dependent only if the custodial parent signs a written declaration releasing the claim to the dependency exemption.
• This is typically done using Form 8332, Release/Revocation of Release of Claim to Exemption for Child by Custodial Parent. The noncustodial parent attaches it to their return.
• Historically, this release also allowed the noncustodial parent to claim certain child-related tax credits (e.g., Child Tax Credit), but it does NOT transfer all benefits (such as the Earned Income Tax Credit, dependent care credits, or head-of‐household status) to the noncustodial parent.

4) “Tie-Breaker Rules” if more than one person could claim
If more than one person meets the qualifying child tests, the IRS applies tie-breaker rules in this order:
1. Parent(s) filing jointly.
2. Parent with whom the child lived longer during the year.
3. Parent with higher AGI if custody is equal.
4. A non-parent with higher AGI only if no parent claims the child.
These tie-breaker rules apply not just to the dependency exemption, but to related tax benefits like Child Tax Credit, dependent care benefits, and EITC.

5) Alternate years or agreements
• Parents can agree among themselves to alternate claiming the child on their tax returns (e.g., Dad claims in odd years, Mom in even years). But the IRS still uses its own custody counting and tie-breaker rules if both try to claim the child on the same year’s returns.
• A court order alone does not override the IRS test — the IRS follows its own statutory rules, not state custody orders.
