On April 23, 2024, the Biden Administration, through the US Department of Labor (DOL), announced its final rules regarding overtime pay for all United States employees. These rules, which take effect July 1, 2024, will significantly impact which employees qualify for exemption from overtime pay as “white collar” and “highly compensated” employees.

Employers, especially churches and religious nonprofit organizations, are going to be the hit hard by these new rules. If you or your employer are concerned about how these changes are going to affect your organization, please contact Simms Showers LLP - DC Metro, we would be happy to conduct an HR audit and provide recommendations on how to restructure your human resources.

Creating a tax-exempt nonprofit is similar to building a house. 🏠 If you do not have a solid foundation, it will all come crashing down around you.

If you have thought about starting a nonprofit, there are a few key things that you should have nailed down BEFORE starting the incorporation process. Having these matters settled before contacting a knowledgeable tax-exempt attorney will save you, your Board, and your nonprofit a lot of time - and a lot of additional expense 💲💲 - in getting your nonprofit off the ground. The attached article briefly covers those keys matters that you should consider before incorporating your nonprofit and seeking federal tax-exemption. We would be glad to schedule an initial consultation with you if you have any additional questions about setting up a tax-exempt nonprofit.

We are a nationally recognized law firm that specializes in church and tax-exempt law. We have assisted hundreds of churches and tax-exempt nonprofits through numerous legal issues including governance matters, liability risk management, land use, tax-exemption matters, employment, religious liberty, foreign grants, and Christian conciliation.
