Labor Day weekend is finally here, and for a lot of families around Lawrenceville, it's the last real breath of summer before the calendar fills back up.

Georgia highways get busy this weekend, and patrols get heavier right along with the traffic. Make a plan ahead of time if there's going to be drinking involved. A little thinking ahead saves a whole lot of trouble and keeps everyone safe.

You've probably heard it called a "no contest" plea. It sits in a strange middle space between guilty and not guilty. You aren't admitting you did it, but you're also not asking the court to decide.

On a moving violation, a nolo plea can keep points off your driver's license, which matters because 15 points in a 24-month window triggers a suspension. It also can't be used against you as an admission of guilt in a related civil case, so if there was property damage or an injury involved, that protection is worth understanding.

You only get one nolo plea every five years in Georgia, so using it on a minor citation that wasn't going to hurt your record anyway is a waste.

That question is not a formality. When police ask for consent, it often means they don't have a warrant or enough probable cause to search on their own.

Saying yes hands them access they didn't already have. Saying no doesn't make you look guilty, and it isn't obstruction. It's a Fourth Amendment protection that belongs to you.
You can decline calmly. "I do not consent to a search" is enough. And if they go ahead and search anyway, don't resist in the moment. Let your attorney challenge it later in court, where the fight is actually won.

Did you know a DUI arrest in Georgia starts two separate clocks? One is your criminal case in court. The other runs through the Department of Driver Services, and most people don't hear about it until after it's already closed.

When you're arrested for DUI, the officer can begin an administrative suspension of your license right away. You have 30 calendar days from the date of your arrest to request a hearing challenging that suspension or to apply for an ignition interlock permit instead. Miss the window, and your license is suspended automatically once your temporary permit expires, roughly 45 days out.

The part that catches people off guard is that this happens on its own track. It doesn't wait for a verdict, and it can take effect even if you're never convicted of anything.
