There is another new case discharging student loan debt as an "undue burden," the current standard under our bankruptcy law. The courts appear to be applying the standard more broadly with each new case. They appear to be doing what the Congress has failed to do for student loan debt relief. The case is Wheat v. Great Lakes Higher Education Corp. B.R. Middle District Ala. Jan. 2022. Stay tuned to this page for further updates.

Without a lawyer, owners filed for Ch. 7 bankruptcy, instead of Ch. 11. Now, their Bronx apartment building is headed for auction.

There was a very notable opinion issued on 6/21/21 in our Maryland Bankruptcy Court. Judge Harner determined that some of debtor’s student loan debt is dischargeable. This is very significant in our district. The trend is toward allowing dischargeability of some if not all student debt. Contact me for more information. 301-541-3408.

The WEP and GPO reduce or eliminate Social Security benefits for many that are those who are covered by government-sponsored pension plans

The Truth shall make your free. Bankruptcy is all about telling the truth. Creditors do not want to spend good money on collection attorneys, and court fees, attempting to collect on uncollectible debtors. Telling them your broke, never works because if it did everyone would do it and if collectors stopped collecting every time someone said they couldn't afford to pay, collectors would never do their job. Bankruptcy is as much for the benefit of creditors as debtors, and society as a whole, to rehabilitate debtors so they can better bear their future expenses, to promote efficiency and transparency in the liquidation of delinquent debts. You tell the truth and do what the law requires. Debtors can voluntarily pay anyone after the bk. Stop telling the lie that you will pay your debts when you are not, can not and will not be able to.
