⚖️ FACT OR FICTION: TAX DEED CONFIRMATION

“Once you receive a tax deed, you automatically have an unchallengeable title to the property.”

🚨 FICTION.

In Mississippi, a tax-sale purchaser can pursue a court proceeding to confirm and quiet the tax title after the redemption period has expired. Mississippi law provides for these proceedings in chancery court.

Why does that matter?

A tax sale involves specific statutory requirements—including required notices. Mississippi courts have emphasized that failures to comply with those requirements can affect whether a tax title can ultimately be confirmed.

Tax deeds can be complicated. If you purchased property at a tax sale or are dealing with property that has a tax-sale history, proper legal review can be extremely important. And we can help!

Did you know?

Buying property at a Mississippi tax sale doesn't necessarily mean your work is finished once the redemption period expires.

In Mississippi, a person holding or claiming under a tax title may bring a proceeding in chancery court to have the tax title confirmed and quieted after the redemption period has expired.

So, what is tax deed confirmation?

It is a legal proceeding designed to establish and confirm the purchaser's title to property acquired through a tax sale.

A confirmation proceeding can involve:
✔ Filing a sworn complaint in chancery court
✔ Identifying parties who may have an interest in the property
✔ Providing the required notice
✔ Obtaining a court judgment confirming the tax title

Once entered, the judgment can provide conclusive evidence of title against persons claiming under the title that existed before the tax sale.
