Federal employees: the way the MSPB reviews disciplinary penalties has changed.

Michael Macomber, Esq., explains the shift from the mandatory Douglas Factors framework to a “totality of the circumstances” review for appeals filed on or after October 5, 2026.

Your disciplinary history, length of service, and potential for rehabilitation can still matter. The Board will consider the relevant circumstances of each case when reviewing whether a penalty is reasonable.
