To create a legal binding prenuptial agreement the following general principles should be adhered to:

-Both parties should fully disclose all assets. If either person has hidden something material the prenuptial agreement can be held invalid.
-The agreement should be signed as early as possible to avoid any potential claims of duress or pressure to sign by one spouse.

Equitable Distribution

All property acquired by either, or both, spouses during a marriage, and up until the start of the divorce action, is considered marital property. It does not matter whose name the property is in, it will be subject to equitable distribution by the Court if it was acquired during marriage.

Similarly, any debt that was acquired by either or both spouses in that same time, will be considered “marital debt”, and will also be subject to equitable distribution.

Contested Divorce.

During the litigation process both parties will be required to engage in financial discovery. Depending on the case, this may include the exchange of financial documents and/or depositions. Depositions are when the parties are asked questions under oath. The discovery process may also include appraisals of any marital property and valuations of businesses.

After discovery is complete it is customary for the two side to try to reach an agreement. If an agreement cannot be reached the case will proceed to a trial. After trial the Judge will render a decision resolving all of the ancillary issues to your divorce.
