In reality, a will doesn't avoid probate—it tells the court how you want your assets distributed. In many cases, the probate process is still required.

Here's a quick breakdown:

✅ A. Home in a Trust
Property held in a properly funded trust will generally avoid probate because the trust already owns the asset.

✅ B. Joint Tenancy
In many cases, ownership passes directly to the surviving owner, allowing that property to avoid probate.

✅ C. Will Only

After expressing your condolences, they ask:

"Can we list the house?"

It seems like a simple question.

But the answer isn't always simple.

Sometimes the home can be sold right away.

As a Realtor, your first instinct is to help.

But before scheduling photos, ordering the sign, or discussing price...

Pause.

These five questions can help uncover issues early and guide your client in the right direction.

1️⃣ Has anyone spoken with a probate attorney yet?

This helps determine whether probate is involved and what legal authority may be needed before moving forward.

2️⃣ How is the property titled?

Was it owned by a trust? Joint tenancy? Community property? Sole ownership?

How title is held can significantly affect the next steps.

3️⃣ Who has the legal authority to sign?

Being an heir doesn't automatically mean someone has authority to sell the property.

4️⃣ Is there a mortgage, HELOC, or other liens?

Understanding existing obligations early helps avoid surprises during escrow.

5️⃣ Are all family members on the same page?

Sometimes the legal process is straightforward.

Family communication isn't always.

Taking time to identify concerns early can help prevent delays later.
