Breaking - Nearly Half Of All Michigan S*x Offenders Were Just Removed From The Registry.
Lansing, MI - Michigan has removed more than 20,000 people from the S*x Offender Registry following a court order.
Michigan State Police has removed more than 20,000 people from the state’s S*x Offender Registry following a Michigan Supreme Court ruling that barred the state from retroactively applying its current registration law to people whose offenses occurred before July 1, 2011.
The removals represent nearly half of Michigan’s registry. Approximately 43,000 people were actively registered or required to register when the court issued its order, according to an official statement released by Michigan State Police.
“As of Friday, September 11, the MSP has removed more than 20,000 offenders,” the department said. MSP added that the total could change as officials continue reviewing registry records.
The removals follow the Michigan Supreme Court’s Sept. 9 order in People of the State of Michigan v. Eddie Lee Smith. Smith committed the crimes involved in his case in 1995 and 2010 but was being required to register under Michigan’s substantially amended 2021 S*x Offender Registration Act.
The court found that the requirements added after Smith committed his crimes constituted punishment. Applying those requirements retroactively therefore violated prohibitions against ex post facto punishment contained in both the United States and Michigan constitutions.
The court ruled that the 2021 law cannot be retroactively applied to people whose registry-triggering criminal acts occurred before the 2011 amendments took effect.
Michigan State Police emphasized that it did not independently decide to remove the registrants. The department maintains the registry and said it is legally required to comply with the Supreme Court’s decision.
“The MSP did not make this change to the law,” MSP Director Col. James F. Grady II said. “However, the department maintains the database, is required to comply with the Court’s order and is taking the necessary steps to implement the ruling.”
The decision does not overturn or expunge the underlying criminal convictions of those removed. It also does not affect people whose qualifying offenses occurred on or after July 1, 2011, who remain subject to Michigan’s current registration requirements.
MSP has not released the names of those removed or a county-by-county breakdown.
The department said questions about changing the law should be directed to the Legislature, while suspected errors involving people who remain registered for offenses committed on or after July 1, 2011, should be reported to the MSP S*x Offender Registry Unit or the local law enforcement agency responsible for the person’s registered address.
