Jaime Jackson Law recently settled a case involving a defective and counterfeit airbag which caught fire in a 2021 Chevrolet Malibu following a frontal impact. Our 21-year-old client, who had recently given birth, suffered second and third degree burns to her wrist, chest, and abdomen. She was also unable to nurse her newborn daughter as a result of her burn injuries.

A crashworthiness case is not simply how a collision occurred. It is whether the vehicle’s structure, restraint system, airbag, seat, or another safety feature failed to protect the occupant from an injury that could have been prevented or mitigated. A biomechanic provides the bridge between the crash and the injury by considering what happened to the human body during the crash and whether the proposed injury mechanisms are consistent with the physical evidence.

Establishing that connection requires telling a coherent story: What happened to the vehicle? What happened to the occupant? How did the occupant move inside the vehicle? What did the occupant contact? And how did those interactions produce or contribute to the occupant’s injuries?

That is where a biomechanic can play a critical role.

SUVs and pickup trucks have never been bigger.

Unfortunately, neither has the danger they pose to pedestrians.

A recent New York Times investigation found that taller vehicle hoods and larger blind spots may have contributed to more than 3,000 pedestrian deaths in the United States since 2016.

Why? Because modern trucks and SUVs are more likely to strike a pedestrian's torso or head rather than their legs, causing far more severe injuries.

Meanwhile, many European countries have adopted pedestrian-focused vehicle safety standards while pedestrian deaths in America remain alarmingly high.
