During the 2026 Regular Legislative Session Civil Code Article 138 was modified. The modifications which went into effect on August 1, 2026 updated the landmark Bergeron v. Bergeron child custody modification standard.

The law formally writes the heavy-burden rule into the civil code but also added a specific five-year framework for considered decrees.
