Thinking about Pre-Trial Diversion for your DWI?

Be careful — in Louisiana, you can’t expunge it for 5 years after finishing the program.

That’s five years of background checks showing an arrest.

Federal vs. State Criminal Defense

Federal cases are prosecuted by the U.S. Attorney’s Office and involve agencies like the FBI or DEA — with tougher penalties and stricter procedures than state court.

At Boustany Law Firm, we routinely handle both federal and state criminal cases, providing skilled defense in every courtroom.

🚨 Should You Blow or Not Blow? 🚨

In Louisiana, the law changed in August 2023:

Under .15 BAC → 90-day suspension
15 or higher → 2-year suspension (used to be .20)

⚖️ If we request a hearing within 30 days of arrest, we could save your license.

👉 Our advice: Don’t blow. The penalties are harsher than ever.

🚗 Louisiana DWI/DUI License Hearings – 30 Day Deadline 🚨

In Louisiana, you only have 30 days after a DWI/DUI arrest to request a hearing on your driver’s license. If no hearing is requested, you could lose your license and be required to install an ignition interlock device in your vehicle.

Even if you are offered pre-trial diversion, most programs require you to use an interlock device. But if we timely request a driver’s license hearing, we may be able to save your license—and you may never have to put an interlock in your car.

If you or a loved one has been arrested for DWI in Lafayette or anywhere in Louisiana, don’t wait. Contact our office today to protect your license and your future.

🚨 Louisiana DWI Law Change – Jury Trials Now for 1st Offense

Louisiana just made a big change:

If you’re charged with a 1st offense DWI, your case can now go before a 6-person jury — not just a judge.

This is more than a technical change. Jury trials require a completely different approach, strategy, and skill set — and not every attorney has recent jury trial experience.

If you’re facing a DWI charge, ask your lawyer:
“When was your last jury trial?”

At Boustany Law Firm, ours was just over a month ago — and we’re ready for the next one.
