A hotel is not automatically responsible because a sexual assault occurred on its property. Liability may depend on whether the hotel’s own security failure contributed to the event.

A legal investigation may examine:

⚫️ Improperly issued room keys
⚫️ Master key use
⚫️ Electronic door access logs
⚫️ Broken locks
⚫️ Employee misconduct
⚫️ Prior guest complaints
⚫️ Suspicious activity reports
⚫️ Surveillance video
⚫️ Security and staffing contractors

Hotels often overwrite video and electronic access data under routine retention practices. Prompt preservation can be critical.

Property ownership alone is not enough. The evidence must connect notice, control, security practices, and causation to the assault.

Police officers hold authority to stop, search, arrest, transport, and detain. Sexual abuse committed through that authority can raise both state civil claims and federal constitutional issues.

Important evidence may include:

⚫️ Body camera and dash camera video
⚫️ Dispatch audio
⚫️ Vehicle location data
⚫️ Stop and booking records
⚫️ Building access logs
⚫️ Medical records
⚫️ Prior complaints
⚫️ Internal affairs files

A federal claim under Title 42 Section 1983 may apply when a person acting under state authority deprives someone of protected rights. A city or county is not automatically liable simply because it employed the officer. Additional proof concerning policy, custom, training, supervision, or official decisions may be required.

Video and electronic records can be overwritten, so prompt preservation matters. A criminal or internal investigation does not automatically protect every civil deadline.

Sexual abuse at work may involve:

⚫️ A supervisor or owner
⚫️ An adult coworker
⚫️ A customer or vendor
⚫️ Threats involving shifts or termination
⚫️ Private closing assignments
⚫️ Rides or off site meetings
⚫️ Retaliation after a report

An employer is not automatically responsible for every act by another person. Its own conduct matters, including what managers knew, how complaints were handled, and whether adults working with minors were supervised.

Work schedules, payroll records, messages, video, complaints, and disciplinary notices can be important evidence. Employment discrimination procedures and civil sexual abuse claims may also have different deadlines.

Private tutors, music teachers, coaches, and other instructors may spend repeated time alone with children in homes, studios, vehicles, or online lessons.

When sexual abuse occurs, a legal investigation may examine:

⚫️ The individual instructor
⚫️ A tutoring or placement company
⚫️ A studio or academy
⚫️ Background check promises
⚫️ Prior complaints
⚫️ Private messaging and online records
⚫️ Transportation and travel
⚫️ Rules for doors, windows, and parent access

A company is not automatically responsible for every act by an instructor. Its own conduct matters, including how it selected the instructor, what it controlled, and how it responded to warning signs.

Parents should preserve complete messages, contracts, schedules, payments, and platform information. They should also avoid repeatedly questioning the child and allow trained professionals to conduct formal interviews.

A Missouri survivor may have experienced sexual abuse at an out of state camp, school, church, tournament, hotel, or family home. Living in Missouri today does not automatically determine where a lawsuit can be filed or which state’s law applies.

A legal review may consider:

⚫️ Where the abuse occurred
⚫️ Where the offender lives
⚫️ The institution’s Missouri connections
⚫️ Where decisions and warnings occurred
⚫️ Where records and witnesses are located
⚫️ Personal jurisdiction and venue
⚫️ The filing rules of several states

Missouri law may apply to some issues while another state’s law applies to others. Each defendant can also present a different jurisdictional question.

Filing deadlines are especially important because the connected states may use very different rules. Survivors should not rely only on the most generous deadline found online.
