Mental Health Therapists Win Collective Certification!

On March 10, 2026, Plaintiffs in the case against Mississippi Behavioral Health Services succeeded in getting collective certification. Judge Carlton W. Reeves of the United States District Court for the Southern District of Mississippi issued an Order certifying this case as a collective action (click here to read the Order). This authorizes Plaintiffs to send a Notice to all former and current workers who are potential collective members explaining their right to join the case. The ruling also directed MBHS to provide Plaintiffs’ Counsel with names and contact information of potential collective members by March 31, 2026. Once we receive this information, Plaintiffs’ Counsel will send the Notice by mail, email, and text message. This effort could significantly increase the number of Opt-in Plaintiffs in this case, which is currently at 23. To join the case, members of the collective must complete a Consent to Sue form and return it to Plaintiffs’ Counsel by May 11, 2026.

On March 12, Representative Alexandria Ocasio-Cortez (NY-14) and Senator Patty Murray (WA) introduced legislation to guarantee minimum wage and overtime protections for home care workers. The Fair Wages for Home Care Workers Act would protect the right to fair pay for over 3 million home care workers.

Home care workers were exempt from federal wage protections until 2013, when the U.S. Department of Labor expanded minimum wage and overtime protections. In 2025, the Trump administration proposed to roll back those protections.

This important piece of legislation is cosponsored by 58 representatives and 17 senators.

This Labor Day, take a moment to help workers by submitting a comment to the U.S. Department of Labor in opposition to their proposal to cut federal minimum wage and overtime protections for millions of home care workers.

The DOL’s proposal to cut homecare workers rights is a part of a long, ugly history. In 1938, domestic workers were excluded from federal labor laws on purpose in order to appease segregationists. And even now, close to a century later, care workers – mostly Black, brown, and immigrant women – are still fighting for the basic respect that others take for granted. But home care workers all over the country won wage protections in 2013, and we have to do our part to make sure they keep those rights.

If the current administration succeeds, they won’t stop with home care. This is a fight for the dignity of ALL workers and for a care system that values people over profit. Tell the Department of Labor: stop the rollback. Protect care workers now.

Getman, Sweeney & Dunn has filed a lawsuit on behalf of security guards who worked for DMV Protection and its affiliates (hereinafter “DMV Protection) and Jovan Vladic (together “Defendants”). The lawsuit alleges that DMV Protection violated the federal Fair Labor Standards Act (“FLSA”) by failing to pay Named Plaintiff and other security guards overtime wages. It also alleges that DMV Protection violated wage payment laws of Virginia and Maryland by putting in place several policies where guards’ time was forfeited (late arrival, early departure, and failure to submit Daily Activity Reports). Additionally, it alleges that DMV Protection violated Virginia state law by misclassifying workers as independent contractors. We filed this case in the U.S. District Court for the Eastern District of Virginia.

DMV Protection paid the Named Plaintiff and other security guards an hourly rate. The Named Plaintiff and the other security guards regularly worked in excess of 40 hours per week. This case seeks to compel DMV Protection to pay Named Plaintiff, other security guards, and other similarly situated employees the unpaid wages, an additional and equal amount as liquidated damages, and any other statutorily provided damages.
