Termination of Haiti TPS blocked by Federal Judge on February 2, 2026.
US district Court of appeals kept the injunction ion place.
On Wednesday, March 11, 2026 DHS asked the US Supreme Court on an emergency basis to allow it to proceed with the deportation while the case proceeds through the District Court.
Supreme Court set Monday, March 16, 2026 for reply by plaintiffs.
Meantime, Syrian TPS termination has been blocked by injunction.
DHS has asked US Supreme Court in an emergency filing to make an Order that the Courts do not have the authority to review TPS Termination decisions made by DHS.
We may have major decisions in the next 30 days.

What this means for Forms I-766, Employment Authorization Documents (EADs):

The validity of Employment Authorization Documents (EADs) issued under the TPS designation of Haiti with an original expiration date of February 3, 2026, August 3, 2025, August 3, 2024, June 30, 2024, February 3, 2023, December 31, 2022, October 4, 2021, January 4, 2021, January 2, 2020, July 22, 2019, January 22, 2018, or July 22, 2017 is extended per court order. Miot et al. v. Trump et al., No. 25-cv-02471-ACR (D.D.C.).

When completing the Expiration Date (if any) fields on Form I-9, input “as per court order” in Section 1 and “03-15-2026” in Section 2 along with a note in the additional information box. Employers may download the Alert and TPS Haiti webpages and attach them to Form I-9. Check back to USCIS websites regularly for updated information. When completing a case in E-Verify, enter the expiration date of “03-15-2026” from the Form I-9. Check back to USCIS websites regularly for updated information.

Update on Termination of Temporary Protected Status for Haiti
The TPS designation of Haiti and related benefits was set to terminate on February 3, 2026. However, on February 2, 2026, the U.S. District Court for the District of Columbia issued an order staying the TPS Haiti termination. Miot et al. v. Trump et al., No. 25-cv-02471-ACR, D.D.C.).

TPS Haiti beneficiaries will keep their status and employment authorization, and their documentation will remain valid per the above court order. Forms I-766, Employment Authorization Documents (EADs) with category A12 or C19 remain valid and are extended. Refer to the EAD Extension dropdown on the TPS Haiti page for EAD expiration dates that are extended pending the resolution of the litigation.

SAVE will verify if an alien has received an approval for TPS that has not been withdrawn using information from any TPS-related document, such as a Form I-797, Approval Notice, or Form I-797C, Notice of Action. TPS beneficiaries will receive a SAVE manual response of:

“Temporary Protected Status – Employment Authorized - Temp Emp Auth”;
The employment authorized through date will be the Employment Authorization Document (EAD) expiration date of “March 15, 2026"; and
DHS Comments “TPS and employment authorization are extended per court order. Please check the USCIS TPS Haiti page regularly for updates.”
As this matter is in active litigation, the status of the individual's TPS and employment authorization is dependent on developments in the litigation. This probably explains why there have not been any approvals of TPS for the latest extension to February 2026.
From USCIS Website 02-20-25:
ALERT: The Department of Homeland Security has extended through Aug. 3, 2025, the validity of certain Employment Authorization Documents (EADs) issued to Temporary Protected Status (TPS) beneficiaries under the designation of Haiti.
USCIS has automatically extended through Aug. 3, 2025, the validity of EADs issued under the TPS designation for Haiti with an original expiration date of:
Aug. 3, 2024;
June 30, 2024;
Feb. 3, 2023;
Dec. 31, 2022;
Please note this may be the final time USCIS will automatically extend Haiti TPS-based EADs with the notation A-12 or C-19 under Category and a Card Expires date of Dec. 31, 2022; Oct. 4, 2021; Jan. 4, 2021; Jan. 2, 2020; July 22, 2019; Jan. 22, 2018; or July 22, 2017.

The Trump administration has rolled back an 18-month extension of deportation protections for over half-a-million Haitians currently residing in the United States, creating uncertainty and anxiety for recipients of the status.

TPS VENEZUELANS
The Administration did NOT end TPS for Venezuelans.
Venezuelans have two designations for TPS: in 2021, ending in September 2025; and in 2023, ending in April 2025.
Myorkas combined the two and gave a new ending date of October 2026.
The Administration revoked the January 10, 2025 combination and extension order.
This reverted back to the two separate ending dates of April 2025 and September 2025.
There is no indication that the Administration made any decision on the April 2025 ending date.
In that case this one (ending April 2025) is automatically extended to October 2025.
Now, one designation ends in September 2025, and the other ends in October 2025.

Vacatur of Myorkas’ January 10, 2025 Extension of TPS for Venezuelans
I. At least 60 days before the expiration of a foreign state's TPS designation or extension, the Secretary, after consultation with appropriate U.S. Government agencies, must review the conditions in the foreign state designated for TPS to determine whether they continue to meet the conditions for the TPS designation. See INA 244(b)(3)(A), 8 U.S.C. 1254a(b)(3)(A). If the Secretary determines that the conditions in the foreign state continue to meet the conditions for TPS designation, the designation will be extended for an additional period of 6 months or, in the Secretary's discretion, 12 or 18 months. See INA 244(b)(3)(A), (C), 8 U.S.C. 1254a(b)(3)(A), (C). If the Secretary determines that the foreign state no longer meets the conditions for TPS designation, the Secretary must terminate the designation. See INA 244(b)(3)(B), 8 U.S.C. 1254a(b)(3)(B).
III.B
If the Secretary does not make a timely determination (for example, if the Secretary were not to make determination by February 1, 2025 whether to extend or terminate the 2023 Venezuela TPS designation), then the statute provides for an automatic extension of the designation for an additional period of 6 months. INA 244(b)(3)(C), 8 U.S.C. 1254a(b)(3)(C).
IV. Notice
As a result, the Venezuela 2023 TPS designation and the Venezuela 2021 TPS designation remain in effect and their associated statutory deadlines remain in effect.
The law referred to in the Federal Register Notice is
8 U.S. Code § 1254a - Temporary Protected Status
8 U.S.C. 1254a(b)(3)(B).
(A) Periodic review
At least 60 days before end of the initial period of designation, and any extended period of designation, of a foreign state (or part thereof) under this section the Attorney General, after consultation with appropriate agencies of the Government, shall review the conditions in the foreign state (or part of such foreign state) for which a designation is in effect under this subsection and shall determine whether the conditions for such designation under this subsection continue to be met. The Attorney General shall provide on a timely basis for the publication of notice of each such determination (including the basis for the determination, and, in the case of an affirmative determination, the period of extension of designation under subparagraph (C)) in the Federal Register.
(B) Termination of designation
If the Attorney General determines under subparagraph (A) that a foreign state (or part of such foreign state) no longer continues to meet the conditions for designation under paragraph (1), the Attorney General shall terminate the designation by publishing notice in the Federal Register of the determination under this subparagraph (including the basis for the determination). Such termination is effective in accordance with subsection (d)(3), but shall not be effective earlier than 60 days after the date the notice is published or, if later, the expiration of the most recent previous extension under subparagraph (C).
(C) Extension of designation
If the Attorney General does not determine under subparagraph (A) that a foreign state (or part of such foreign state) no longer meets the conditions for designation under paragraph (1), the period of designation of the foreign state is extended for an additional period of 6 months (or, in the discretion of the Attorney General, a period of 12 or 18 months).

TPS extended AND Re-designated for HAITI.
In an advance copy of the Federal Register announcement the DHS is not only extending TPS until April 2026 but also re-designating TPS for Haiti for those who entered the US before June 3, 2024.
Those who have EADs from the 2010 /2011 designations, and have had it extended by the Ramos case injunction, were scheduled to expire on June 30, 2024. As well as those whose EADs were to expire on August 3, 2024, will be auto-extended to August 3, 2025.
The Notice will be formally published in a few days.

Do you employ Temporary Protected Status (TPS) Beneficiaries? If so, they may be eligible for an up to 540-day extension of their EAD.

If an individual with TPS or a pending TPS application applies to renew their TPS Employment Authorization Document (EAD) on or before October 26, 2023, according to the relevant Federal Register notice relating to their TPS country designation, their TPS EAD is extended for up to 540-days from the date shown on their TPS EAD.

When completing Forms I-9, an employee may present a facially expired EAD with a category code of A12 or C19 with a Form I-797C that a) has a filing date after the “Card Expires” date on their EAD and b) indicates eligibility for automatic EAD extension. Employers cannot reject acceptable Form I-9 documentation.

For the Federal Court case in Texas about the Cuban Haitian, Nicaraugan, Venezuelan Parole Program:
Judge Tipon issued the following Order:
ORDER
Pending before the Court is Federal and Intervenor Defendants’ Unopposed Request to Continue Deadlines for Briefing on Plaintiff States’ Motion for Preliminary Injunction [ECF 22]. (Dkt. No. 160). After reviewing the Motion, the record and the applicable law, the Court is of the opinion that it should be DENIED.
As stated previously, the Court will not rule on the motion for preliminary injunction until after the trial has been completed, which is now scheduled for August 24, 2023. This is because the motion has been consolidated with the trial on the merits. The briefing currently ordered by the Court is to assist the Court in preparation for trial. The Parties will have many opportunities to provide the Court with many briefs, including after trial when the actual evidence (as opposed to discovery) will govern the Court’s ruling.
It is SO ORDERED. Signed on June 8, 2023."
And in another order:
"The Parties shall appear in-person for a Final Pretrial Conference on August 23, 2023, at 1:00 p.m. in Victoria, Texas. The Court may address pending motions and objections and pre-mark and pre-admit exhibits.
Trial shall begin on August 24, 2023 at 9:00 a.m. in Victoria, Texas.
No later than September 29, 2023, the Parties shall file Proposed Findings of Fact and Conclusions of Law with citations to the record from trial. If the Parties wish to file any post-trial memoranda of law, they must do so no later than this date."
Based on this Order, it now appears that there will be no Decision until early to late October, 2023. "
