Generally, this is a no.

Attorney-client privilege is designed to protect communication between the attorney and the client only. Once an unnecessary third party joins the discussion, the privilege may be waived. In other words, attorney-client privilege in Georgia can sometimes be lost simply because another person was present.

There’s also another concern: while your attorney is legally obligated to protect your confidentiality, your family members and friends are not. Even unintentionally, they could repeat something they heard to someone else, harming your case.

A safer option is often to have loved ones accompany you to appointments, but remain outside the meeting itself. They can still provide support without risking your privacy or legal protections.

While it may feel like you need to have a family member present when talking with your personal injury attorney, it’s not always necessary.

In some cases, when a third party is needed to help with your case, they may fall within the protection of attorney-client privilege. Examples can include:

- Interpreters
- Medical professionals
- Financial consultants
- Accident reconstruction experts
- Private investigators

However, a friend or family member who is present only for emotional support is usually different. Their presence can put the confidentiality of the conversation at risk.

Not every conversation with a lawyer is automatically protected. Attorney-client privilege only applies to communications involving legal advice or legal strategy. This means parts of larger conversations might not be private.

For example, facts themselves are not always protected, even if discussed within the framework of legal advice. Likewise, conversations unrelated to your legal situation are not covered by privilege.

If you spend part of your meeting discussing your favorite restaurants or the outcome of the Super Bowl, those casual topics won’t be protected under attorney-client privilege.
