It’s one of the most common assumptions people make when heading into a legal battle. But by default, each party pays their own attorney's fees, win or lose. The court does not automatically hand the bill to the loser just because you were right. 🛑

If you want to recover your legal fees in a Texas courtroom, you must have a specific, concrete legal basis. This almost always comes down to two things:

✅A Clear Contract: Your agreement explicitly stated that the "prevailing party" gets their fees covered.

✅Statutory Authority: Your claim falls under specific Texas laws that allow fee-shifting, like a breach of contract under Chapter 38 of the Texas Civil Practice & Remedies Code, the DTPA, or statutory fraud.
