⚖️ Writs of Habeas Corpus ⚖️

Right now, people who are detained and held in Kansas have a good chance of being granted a Writ of Habeas Corpus allowing them to then apply for release on bond at the Immigration Court, even if they originally entered the country without authorization.

While we strongly disagree with the government’s arguments that such people are not eligible for a bond, at least most of the Courts around the country have agreed with our position.

So how does it work: someone who is detained by ICE and held in a facility in Kansas can file a motion for a Writ of Habeas Corpus from the District Court of Kansas. Today we had two cases where people were granted the lowest possible bond from the Immigration Court ($1500). In those cases they had been detained by ICE in Mid-June 2026. We filed their Habeas petitions with the District Court of Kansas on June 29, 2026, which that Court granted on July 10, resulting in their bond hearings on July 15. That means it is about a 4-week process, and that is IF everything goes smoothly.

In these cases, they were particularly strong bond cases, and they happened to already have hearings set for July 15, which the bond hearings were just added to, but hopefully this gives you all some idea of how and how long this process is taking.
