Congratulations to Partner Patrick Stueve, who recently became a Fellow of the American College of Trial Lawyers - ACTL, recognized as the preeminent organization of trial lawyers in North America.

The induction ceremony at which Stueve became a Fellow took place recently before an audience of approximately 690 during the recent Annual Meeting of the College in Rome, Italy.

Founded in 1950, the College is composed of the best of the trial bar from the United States, Canada, and Puerto Rico.

Fellowship in the College is extended by invitation only and only after careful investigation, to those experienced trial lawyers of diverse backgrounds, who have mastered the art of advocacy and whose professional careers have been marked by the highest standards of ethical conduct, professionalism, civility, and collegiality.

Lawyers must have a minimum of fifteen years trial experience before they can be considered for Fellowship. Membership in the College cannot exceed one percent of the total lawyer population of any state or province.

As part of our nationwide effort to enforce federal and state minimum wage and overtime laws at casinos, our firm recently secured a $12.5 million settlement for workers at Borgata Hotel Casino & Spa in Atlantic City, and MGM National Harbor Hotel and Casino near Washington D.C.

This result is believed to be among the largest tip credit notice settlements obtained in the FLSA’s history.

The United States District Court for the District of New Jersey granted the motion for final approval during a hearing on July 21, 2022. Representing approximately two-thirds of the disputed minimum wages, the $12.5 million fund will provide meaningful settlement payments to workers who are paid below minimum wage.

The largest estimated settlement payment is more than $9,500 and payments of more than $5,000 will be received by approximately one-third of eligible table games dealers.

The estimated per capita settlement checks are more than $1,050 for dealers at Borgata and $4,500 for dealers at MGM National Harbor.

Stueve Siegel Hanson and McClelland Law Firm have reached settlements valued at more than $45 million in unpaid wages for casino workers around the country and continue to play a significant role in reforming casino wage and hour practices.

Among changes influenced: casinos paying the costs of employees’ gaming licenses; removing all supervisory and non-tipped employees from tip pooling arrangements; compliant tip credit notice policies; and paying tip credit employees at the correct overtime rate.

Partner Austin Moore recently discussed the firm's investigation of potential claims against staffing agencies for taking advantage of traveling nurses by making “take-it-or-leave-it” pay-rate reductions in the middle of their contractual term. The situation for some travel nurses has gotten so bad that a law firm in Kansas City, Missouri, said it is considering legal action against more than 35 staffing agencies. Austin Moore, an attorney at Stueve Siegel Hanson, said some agencies are “breaching their contracts” and in other cases “committing outright fraud” through bait-and-switch maneuvers on travel nursing contracts.

The firm opened an investigation in March, drawing comments from hundreds of nurses, Moore said. “Our phones are ringing off the hook,” he said. “Nobody has experienced it like this — historically, contracts have been honored.”

As Covid hospitalizations stabilize and federal and state funding dries up, contracts that were plentiful and lucrative are vanishing.

We are proud to share that our firm has given a $1 million gift to establish a scholarship for Black law students and journalists at the University of Missouri (Mizzou). The Stueve Siegel Hanson Law Scholarship will establish a scholarship for Black students at the University of Missouri School of Law, and the Stueve Siegel Hanson Fund for Press Freedom will support the Alfred Friendly Press Partners at the Missouri School of Journalism.
