Your liability insurance carrier does not have your best interest in mind when you're being sued.

In October 2013 our client suffered a brain injury and other serious injuries in a head-on collision with a drunk driver who had been illegally over served at BoJo’s Bar and Grill.

Following a February 2020 bench trial our client was awarded six million dollars in actual damages and two million dollars in punitive damages. In its ongoing effort to avoid compensating our client, BoJo’s liability insurance carrier, Illinois Casualty Company (ICC), appealed the case to the Missouri Court of Appeals Western District arguing the trial judge misapplied the law. Today, nearly eight years after our client was first injured, the Court of Appeals, in a unanimous decision, affirmed the trial Judgment.

ICC will likely ask the Missouri Supreme Court to review the Western District’s Opinion. If the case is transferred to the Supreme Court, ICC will be able to further injure our client by delaying compensation for at least another year, if not more.

It is important to note that our client offered to settle this case with ICC for less than the $8,000,000.00 she was awarded at trial. However, ICC, who puts its financial interest ahead of the people they insure, seems to prefer paying endless legal fees and expenses rather than compensating those who are injured.

Great result accomplished with the assistance of my co-counsel Annette Griggs of Griggs Injury Law and Andrew LeRoy of Bautista LeRoy. All briefs have been submitted in Illinois Casualty Company's appeal which is pending in the Missouri Court of Appeals for the Western District. I am confident the judgment will be affirmed.
