We’re happy to share that the KCPA’s Bears on Patrol traveling trophy will be returning to DLM LAW for the second year in a row!

Bears on Patrol helps provide stuffed animals to the Kansas City Police Department (KCPD) so officers can comfort children during difficult or stressful situations. DLM LAW is proud to support this initiative, along with efforts to provide hats and coats to children in our community.

DLM LAW represents over twenty businesses in the trucking industry seeking to hold PACCAR liable for selling trucks equipped with defective engines. Last week, the United States District Court for the Western District of Washington rejected PACCAR’s argument that the Clear Air Act preempts our clients’ claims.

We are pleased with the ruling and look forward to the certification stage.

To learn more, check out Law360's article:

A Washington federal judge ordered PACCAR Inc. to face a proposed class action alleging it sold faulty diesel engines, rejecting its Clean Air Act preemption defense and ruling that the suit plausibly pleads claims that the alleged defects breached the engine warranty.

A contract breach is not just about what went wrong. It’s also about what the agreement required, what happened, and what resulted.

Four questions can help organize the facts:

What did the agreement require?
What was not performed?
What loss followed?
What evidence supports the sequence of events?

The written contract and the parties’ conduct both matter when evaluating a potential breach.

Save this checklist and use it to organize the facts before discussing the dispute with counsel.

How much should an insurance broker be expected to know about the coverage you need?

A recent First Circuit decision involving a long-term relationship between a policyholder and his insurance broker takes a closer look at where a broker's responsibilities begin and end. The case raises an issue that can easily get overlooked when businesses or individuals have worked with the same broker for years.

Familiarity does not always mean both sides have the same understanding of what coverage has been requested, what advice has been given, or what the broker has agreed to handle. Check out our newest blog post to learn more: https://dlmlaw.com/blog/insurance-coverage-and-the-brokers-role/

A missed deadline might sound like a procedural mistake. In litigation, it can be much more serious.

Courts set deadlines for a reason. Missing one can result in evidence being excluded, claims being dismissed, or a client's ability to recover damages being significantly reduced. DLM LAW has discussed cases where a missed filing deadline had consequences reaching into the millions.

But a mistake alone doesn't automatically establish legal malpractice. The key questions include whether the attorney breached the applicable duty of care and whether that failure actually caused the client's loss.

DLM LAW evaluates legal malpractice claims involving substantial harm to businesses and individuals.

An arbitration clause may look perfectly straightforward on paper, but that does not necessarily mean a court will enforce it.

A recent Fifth Circuit decision involving a multimillion-dollar construction dispute took a closer look at what happens when one party has significantly more control over the arbitration process than the other. The ruling raises some interesting questions about how arbitration provisions are drafted, negotiated and ultimately enforced.

A business dispute rarely stays confined to the original disagreement.

For a company facing significant litigation, the real exposure may involve far more than the amount claimed. Ownership interests, business operations, intellectual property, customer relationships, and the value of the company can all be affected by the outcome.

That’s why the bigger picture matters when evaluating a case.

The strength of the claims and defenses, the available remedies, the evidence, and the potential business impact all need to be considered as part of the litigation strategy.

For high-stakes commercial disputes, the goal is to understand the exposure, protect the company’s interests, and pursue the strongest position available. At DLM LAW, we help businesses navigate complex disputes with the bigger picture in mind.
