Pain and suffering doesn't come with an invoice. That doesn't make it any less real.
Medical bills and lost wages are easy to add up. The physical pain, emotional toll, and disruption to your daily life after an accident are not, but Arkansas law still allows you to recover for them. Pain and suffering, also called non-economic damages, can include:
- Ongoing or chronic pain from the injury
- Anxiety, depression, or PTSD following the accident
- Sleep disturbances
- Loss of enjoyment of life
- Limitations in movement or physical ability
There's no formula for calculating it in Arkansas. These damages are proven through medical records, testimony from the people who know you, and documentation of how your daily life has actually changed, not just what the bills say.
