In the realm of Wills and Probate, here are a few common legal terms you should be familiar with:
Testator/Testatrix: The person who creates a will, outlining their wishes for the distribution of their assets after death. "Testatrix" is the female form of the term.
Executor/Executrix: The person appointed in a will to carry out the wishes of the decedent and manage the estate's affairs. "Executrix" is the female form of the term.
Intestate: When a person dies without a valid will, their estate is distributed according to the State's laws of intestate succession.
Caveat/Caveator: With respect to a Will, a caveat is a legal notice that can be filed to prevent the probate court from granting probate or issuing a grant of representation for the will in question. A caveat is a formal objection to the validity of the will. It indicates that the person filing the caveat, known as the "caveator," has concerns or disputes regarding the authenticity, validity, or administration of the will.
Codicil: A codicil is a legal document that is used to make amendments, additions, or revocations to an existing last will and testament. It is essentially a supplementary document that modifies or supplements certain provisions of the original will, rather than replacing the entire will itself.
