My practice is focused on assisting consumers who need help correcting errors and inaccuracies on consumer reports, which includes credit reports,

criminal reports, background checks, employment reports, tenant screening reports or a variety of other types of consumer data reports that are now being sold about consumers. The most common reasons that these errors appear on a report are: agencies mixing information that belongs to another person, identity theft, or errors in source data being provided by banks, debt collectors, insurance companies, landlords, employers, or public record vendors. These types of reporting problems can prevent people from getting jobs, obtaining insurance, renting an apartment, opening a bank account or establishing credit such as mortgages, car loans, student loans, and credit cards. I also represent consumers who are subjected to unlawful harassment by creditors and debt collectors particularly those who are not even responsible for the debt. This type of harassment can include unwanted and unrelenting phone calls to a person's home and cellphone, embarrassing calls and letters sent to family, friends and co-workers, false information being reported to credit bureaus and unfounded lawsuits filed against consumers.

Consumers be forewarned. The increasingly popular checkout option buy now, pay later (BNPL) will soon be appearing on consumer credit reports. BNPL providers like Affirm, Afterpay and Klarna offer point-of-sale installment loans that can be used to pay for purchases online or in-stores at participating retailers. Equifax and Trans Union announced that they will be including BNPL tradelines on traditional credit reports while Experian announced the creation of a one-of-a-kind specialty bureau called The Buy Now Pay Later Bureau which will provide real-time reporting of consumers’ BNPL activity.

This information has never before been incorporated into consumer credit reports or credit scoring models so its reliability and its usefulness remains to be seen.

Good news for consumers and their credit reports. Earlier this year, Equifax, Experian and Trans Union announced in a joint statement that they will no longer include paid medical collection accounts on consumer credit reports.

The three credit reporting agencies will also extend the time period before unpaid medical collections would start reporting on a consumer’s credit report from six months to one year. These changes will take effect on July 1, 2022.

In addition, the joint statement indicated that Equifax, Experian and Trans Union will discontinue reporting any medical collection account that is less than $500 beginning in the first half of 2023. When these changes are implemented, 70% of medical collection accounts will supposedly be removed from American’s credit reports.

Medical debt has never been a good indicator of a consumer’s creditworthiness and is rife with inaccuracies due to the complicated nature of medical billing. Hopefully these changes will bring some much deserved relief to consumers.

Finally some progress to correct the detrimental impact forced arbitration clauses have had on Anericans right to take their legal claims to court. Although this bill only applies to some kinds of employment claims, it’s a step in the right direction and it was nice to see that it gained bipartisan support. I look for to seeing this signed into law by the President, and hopeful that a similar law eliminating forced arbitration clauses in consumer contracts is on the way.

The firm is complying with the executive order of the governor of Pennsylvania ordering all "non-life-sustaining” businesses in the Commonwealth of Pennsylvania to close their physical business locations. The firm, however, is fully equipped to operate virtually and remotely so that there will be no interruption in our business operations, and no health risk to any firm employees or vendors.

I am a small business, and I support small business.
Although my firm is not as directly affected by the decisions of our legislatures to shut down businesses in Pennsylvania, New Jersey and other parts of the country, many small businesses are critically impacted. Soon the hysteria that is going on right now will be over, and we don’t want a world where all small businesses are out of business. So if you’re able, do what you can to help out: order some takeout, buy something online, take a streaming fitness class, prepay for your next hair appointment. One of my goals year is to read 30 books. Book 1 was Permanent Record, a memoir by Edward Snowden. As an attorney who deals with data privacy and data accuracy issues all the time, the book was fascinating. No matter what you think of Edward Snowden, the book raises many concerns about data privacy in America both in the private sector and in government. An interesting read if your concerned about the ever growing invasions of privacy affecting our digital lives.
