Special Monthly Compensation, or SMC, provides additional compensation to certain veterans whose disabilities involve severe impairments or specific circumstances.

Depending on the situation, SMC may be available for things such as loss or loss of use of an extremity, certain reproductive organ disabilities, or qualifying housebound status. There may also be additional VA benefits available to eligible veterans and their families.

If you believe your VA rating does not fully reflect your disabilities or the benefits you may qualify for, it may be worth exploring your options.

TDIU can allow eligible veterans to receive compensation at the 100% disability rate even when their combined VA rating is below 100%.

Working part-time does not automatically disqualify a veteran from TDIU. Depending on the circumstances, a veteran may still qualify if their service-connected disabilities prevent them from maintaining substantially gainful employment.

In some cases, a veteran may also qualify when their disabilities force them to leave a career they were previously capable of performing and take substantially lower-level employment.

A denied PTSD claim isn’t always the end of the road.

In some cases, the VA may be able to concede an in-service stressor based on a veteran’s statements or evidence found in service records. But when a stressor falls outside those circumstances, additional evidence may be needed to verify that the event occurred.

A thorough review of service treatment records, personnel records, and other available evidence can be important when challenging a denial based on an allegedly unverifiable stressor.

If your claim for service connection was denied or you think your rating is too low, visit veteransbenefitslawfirm.net or call 866-866-VETS today.

A 100% VA disability rating can mean more than monthly compensation.

Depending on the severity and nature of a veteran’s disabilities, additional benefits may be available, including Special Monthly Compensation, housing modifications, vehicle assistance, and certain home health care services.

If your VA claim was denied or you believe your rating is too low, it may be worth exploring your options.

Filing a VA claim related to military sexual trauma can involve different types of evidence.

In-service markers, lay statements, and medical evidence may all help support an MST-related PTSD claim. Importantly, the absence of a documented marker does not necessarily mean a veteran cannot establish the claim.

Understanding what evidence may support your claim can help you better understand your options.

Already service-connected for one condition but developed another disability because of it?

You may be able to pursue secondary service connection. A secondary condition can be service-connected when a service-connected disability causes or aggravates another condition. Medical evidence establishing that connection may be required.

Understanding the difference between direct and secondary service connection can make a big difference when pursuing VA benefits.

A nexus opinion can be an important part of a VA disability claim when a veteran has a current disability and an in-service event, but needs medical evidence connecting the two.

A strong nexus opinion should be supported by a thorough review of the veteran’s records and relevant medical evidence. Understanding when a nexus may be needed can help veterans better understand their options.

Appealing to the Board of Veterans’ Appeals may make sense when the VA regional office fails to properly consider the evidence in your claim or does not apply favorable changes in veterans law.

The Board can review the evidence and apply current case law when deciding issues involving service connection or disability ratings.

If your C&P exam felt rushed, inaccurate, or failed to properly address your condition, it’s important to speak up as soon as possible. Documenting your concerns early can help establish that you disagreed with the examination from the outset.

If the VA relies on an inadequate exam, there may be options to challenge it and request a new examination, either before a rating decision is issued or through an appeal afterward.

The effective date can determine how far back VA disability benefits may be paid. Keeping a claim active through the appeals process can help preserve the original effective date and the potential for retroactive benefits.

Understanding your deadlines and taking action after a denial can help protect the date tied to your claim.
