What is a Revocable Living Trust? Do I need one?

Put simply, a Revocable Living Trust (RLT) is a legal entity in which the creator/owner (settlor) places their assets. It may be amended throughout your life and allows for ease of asset distribution to your loved ones without going through probate.

An RLT is changeable and allows for continuous management of assets during your lifetime. As well, it protects your privacy, allows for segregation of assets acquired prior to marriage, and authorizes an appointed person to act on your behalf if you become incapacitated.

To help you learn more we’re posting a blog tomorrow that gives you an in-depth look at Revocable Living Trusts and how they can benefit you. You won’t want to miss this one - trust us!

It’s a common myth that the government can take your money if you don’t have a will.

While the government can’t simply take your assets, without a will you won’t have full control of where your money or estate goes and you’ll have no way to ensure that your loved ones receive what you intend for them. ‘Carpe Diem’ or rather “Seize the Day’ and follow our weekly newsletter to learn more about wills, revocable living trusts, and other ways to protect your family and your future.

Did you know 68% of Americans do not have a will?

Unfortunately, when someone passes intestate (without a will), their beneficiaries do not immediately receive their assets, and they must go through the long and costly process of probate. Don’t be part of the statistic, get your will done and save your family the pain of probate.

Protecting Your Family - Does Probate Avoidance Protect Your Assets?

Our families are what matter most in our lives and we need to ensure that they are protected in the years to come.

Using probate avoidance measures such as creating jointly owned property, life estates, beneficiary designations, and living trusts may minimize short-term costs, but cutting corners now may result in future difficulties for our loved ones.

Probate avoidance does not equal asset protection. It may leave your family vulnerable to issues regarding probate in the future due to creditor claims, additional property not covered by the probate avoidance measures, as well as individual challenges made against the probate avoidance measures.

Protect your assets and get peace of mind knowing your family is safe and secure by seeking guidance from a trusted tax and estate planning attorney.

At Ourednik Law Offices, we offer legal services including Asset Protection, Business Law, Tax Law, Elder Law, and Estate Planning help.

Considering an Offer in Compromise? Here’s what you need to know.

Avoid the traps that some businesses, called Offer in Compromise mills, are offering. They make claims that they can reduce unpaid taxes and charge huge fees to clients, even those who are not eligible to use the program.

Facts: The IRS offers an Offer in Compromise Pre-Qualifier tool to let you know if you are eligible to settle your tax debt for less than the full amount owed. They even provide step-by-step assistance for taxpayers to apply with their OIC video playlist. If you are ever concerned about how to manage your tax debt, be sure to reach out to us at Ourednik Law Offices; we’re here to help.
