When a parent takes or retains a child in another country without consent, the Hague Abduction Convention applies.
What is it?

An international treaty that ensures the prompt return of a child to their country of habitual residence. 3 Key Points:
1. Does Not Decide Custody: Its sole purpose is to safely return the child home, not award custody.
2. Local Courts Decide: Custody matters are handled by courts in the child’s home country after return.
3. Time-Sensitive: Immediate legal action is essential for a successful outcome.

Enforcing an out-of-state judgment in Florida doesn’t mean starting a lawsuit from scratch. Under the Florida Enforcement of Foreign Judgments Act (FEFJA), business owners and creditors can domesticate qualifying judgments from other U.S. states seamlessly. By recording a certified copy of the judgment and filing the required affidavit with the circuit court clerk, you initiate the official registration. Once the mandatory 30-day notice period passes, your judgment gains the full legal weight of a local Florida court order, opening the door to bank garnishments, liens, and asset recovery. 💼⚖️

Won a lawsuit in another US state, but the debtor’s assets are in New York?

Under CPLR 5402, you don’t need to start a new lawsuit in New York. By filing an authenticated copy of the judgment and an affidavit with the New York court, your out-of-state order instantly gains full legal force in New York. This allows you to immediately garnish bank accounts and place liens on property. (Note: Default judgments do not qualify for this expedited process.)

Short Answer: It is non-deductible for the payer and non-taxable for the recipient!

According to the IRS and Florida laws, the tax treatment of alimony depends on whether your divorce agreement was finalized before or after January 1, 2019.

📌 Tax Rules by Date:
Agreements On or After January 1, 2019: The paying spouse cannot deduct alimony payments. The receiving spouse does not pay tax on the income.

Agreements On or Before December 31, 2018: Subject to older rules; the payer can deduct the payments, and the recipient must report them as taxable income.

⚖️ Child Support: Regardless of the date, child support payments are never tax-deductible and are not considered taxable income.

Improper wording in a divorce settlement can lead to unexpected tax liabilities. Contact us to protect your rights and navigate alimony in Florida. 📩

What is the Enforcement of Foreign Judgments in the US?
Did you know that a court judgment obtained in another country is not automatically enforceable in the United States?

To collect financial damages or debts using the debtor’s US assets, the judgment must first be recognized and enforced (domesticated) by the appropriate state court.
📌 The 4-Step Enforcement Process:

1️⃣ Asset Search: Locating the debtor’s assets and accounts in the US.
2️⃣ Jurisdiction Selection: Identifying the correct state to initiate the proceedings.
3️⃣ Court Filing: Submitting the final, non-appealable judgment to the state court.
4️⃣ Collection: Executing liens, garnishments, or asset seizures once approved.
