Legal Fact: In MS, children do not get to choose which parent to live with at age 12. You are doing a disservice to your child if you are raising them to believe that. Nearly once a month, I have to break this news to some 12 year old who thinks he/she can just pick which parent to live with. In a modification of custody case, the parent requesting a change of custody must first prove a material change in the home of the custodial parent which is adverse to the child, then the court has to determine if the change of custody is in the child’s best interest by going through a number of factors. Each of those factors is given equal weight. Only one of the factors is the child’s preference.
