Let’s clear something up real quick.

I hear this all the time:

“My lawyer told me if I file bankruptcy I can’t get my accident money.”

Respectfully… that’s not correct.

Bankruptcy does NOT automatically take your injury settlement.

What actually happens is this:

Some firms sit on injury cases for years while clients:

• can’t work
• bills pile up
• credit gets destroyed

Then the client ends up filing bankruptcy anyway.

Meanwhile they’ve lost valuable time and leverage on their injury claim.

At Law Office of Kimberly S. Sweeney, PLLC, we do things differently.

Because we handle bankruptcy AND personal injury, we know how to:

✔ properly disclose injury claims
✔ protect compensation when possible
✔ keep your case moving so you’re not financially drowning

And yes — our bankruptcy clients have recovered money from their accident claims.

You don’t have to choose between getting out of debt and being compensated for your injuries.

You can do both.

“If I file bankruptcy, I’ll lose my injury settlement.”

That is not automatically true.

At Law Office of Kimberly S. Sweeney, PLLC, we handle both bankruptcy and personal injury, which means we know how to protect your financial recovery.

Here’s what most people don’t realize:

✔ Bankruptcy does not automatically take your injury compensation
✔ Your claim can often be properly protected
✔ We’ve helped multiple bankruptcy clients recover money from car accident claims

Don’t assume you can’t pursue your injury claim just because you’re dealing with debt.

You deserve financial relief AND compensation for your injuries.

Feelings vs. Filings Podcast: Legal Breakdown of ‘Still Fly’ Lyrics (Bankruptcy & Divorce in Mississippi)
Attorneys Kimberly Sweeney (bankruptcy, licensed and practicing in Mississippi; also licensed in Texas and Iowa) and LaJuanda Williams Griffin (Mississippi family and business law) introduce their podcast, “Feelings versus Filings,” which discusses real-life situations from a legal perspective using popular song lyrics. They analyze themes from lyrics about luxury spending, unemployment, unpaid rent, and putting assets “in my mama’s name,” explaining how these issues intersect with Chapter 7 liquidation, Chapter 13 debt consolidation, means testing, exemptions (including Mississippi’s personal property exemption up to $10,000), valuing and protecting luxury items, and the risks of hiding or transferring assets before bankruptcy. They discuss eviction-related strategy in Chapter 13, renting during or after bankruptcy, and how courts may scrutinize expensive car payments (including issues around keeping or surrendering a financed E-Class and how vehicle equity affects whether a trustee would sell a car). From a divorce perspective, they cover potential spousal support based on lifestyle and marriage factors, judicial discretion in Mississippi chancery courts, division of assets including luxury/custom items and celebrity-related value, motions for temporary relief and preliminary injunctions to stop dissipation of marital assets, and how courts can look past title labels to determine whether property held in a parent’s name is actually marital by examining the source of funds, control, and intent. They also address debt incurred in the 90 days before bankruptcy and when creditors may seek nondischargeability, plus the practical costs that affect whether creditors pursue fraud claims.

I’m basically paid to apply pressure.

I’m not the cheapest bankruptcy attorney—and I’m not trying to be. What I do guarantee is this: my clients understand the game and still get to eat.

I run a proven system that makes creditors pay when they violate the automatic stay. They test it. I document it. Then we collect.

Quick example: I just came back from Gulfport for a hearing that was literally just to get a settlement on the record. The creditor tried to play tough… then wired $5,000 about an hour before the hearing to settle.

My client had a check in hand for the same amount as his biweekly paycheck within 15 minutes.

And here’s the part people love: that payout was triple what he paid me to file his case. Client wins. I get my attorney fees. Everybody eats—except the creditor who thought the stay was optional.

I’m grabbing lunch and getting back on the road to the Jack. What y’all eating today?
