Anderson & Makulski, PC wants to thank its amazing staff and wonderful clients and business associates (you know who you are) for a great 2025 year! We also want to thank our families for patience with the crazy hectic lives that we live while trying hard to balance work life and family life. We thank our clients for patience and understanding of that as well. Being a small firm can be tough to make everyone happy, but have no doubt that each and every one of us try our hardest and best to take care of all those in our lives whether it be family or clients (who we consider extended family)! Additionally with staff vacations between Christmas and New Year’s our office will have limited hours and staff during that time.

This morning I learned that Jackson lost one of its true fixtures: Attorney Howard W. Patch. He served so many individuals and business in our community and “treated his clients like family- like gold.” He was a true classy gentlemen. He was a mentor for me and I spent years practicing law with him at my former building and was blessed and honored to take over his practice upon his retirement. Howard, you will be missed by this entire community. Rest in peace.

Did you know that Probate doesn’t just deal with death? It also may be necessary in the event of incapacity (dementia, stroke, etc.) where an individual is unable to manage his/her affairs or make his/her own decisions. Probate involvement in the event of incapacity can be even costlier and more time consuming than in the event of death. Good news, however. For the most part, it can be avoided by two simple and cost effective documents: a Durable Power of Attorney and an Advance Directive. For more information, contact our office.

Will vs. Trust is a question we often are asked by clients. Also, many times we will hear people say a friend told me I really need a trust to avoid probate. Other individuals are shocked to learn that a Will in and of itself will NOT help you avoid probate! So what’s the answer? It depends. None of us have the same family dynamic or same type of assets. Each plan should be unique to your specific situation. While a trust will keep you out of probate if set up and funded properly (a problem we often see), there are many other more cost effective tools ( I call them probate avoidance tools) in our tool box that can be used if a trust really isn’t necessary. The biggest and best advice I can give, however, is to seek legal advice from someone who concentrates in this area of the law whether it be our firm or someone else and get advice and a plan that meets your specific needs and STOP taking advice from friends and talking heads whose situations may be different than yours.

Anderson & Makulski, PC would like to thank the Kiwanis Club of Jackson for installing flags at our firm and throughout our community. Let’s remember that this weekend and Monday in particular isn’t just about pool or lake time and barbecues, but it’s really about those who fought for our freedom and made the ultimate sacrifice while in active duty in the US Armed Forces. I say this every year and should say it every day: only two people ever offered to lay down their lives for you; one was Jesus Christ who died for your eternal freedom from Satan, sin, and death; and the other is the American Soldier who fought for your Earthly Freedom! Let’s never forget their sacrifices!
