DHS Proposes a $103,265 H-1B Fee

DHS has proposed a $103,265 fee for cap-subject H-1B petitions, including change-of-status cases.

Unlike the previously blocked $100,000 fee, the proposal has no national interest exception and could apply broadly to cap-subject petitions.

The fee is not yet in effect. Comments are due within 30 days of the August 25, 2026 Federal Register publication.
