Can you clear a criminal record in California?

Yes, absolutely! There are several legal avenues available today for individuals looking to clean up their record:

𝗙𝗲𝗹𝗼𝗻𝘆 𝗥𝗲𝗱𝘂𝗰𝘁𝗶𝗼𝗻𝘀 (PC 17(b)): If you were convicted of a "wobbler" felony, California Penal Code 17(b) allows the court to reduce the felony charge down to a misdemeanor.

𝗘𝘅𝗽𝘂𝗻𝗴𝗲𝗺𝗲𝗻𝘁: Once a charge is a misdemeanor, you can petition the court to expunge the case from your record. This keeps past convictions from showing up on standard background checks for employment and housing.

𝗥𝗲𝗰𝗼𝗿𝗱 𝗦𝗲𝗮𝗹𝗶𝗻𝗴: Additionally, the California Department of Justice has expanded efforts to seal eligible expunged records, providing an even stronger layer of privacy and protection.

One thing I tell people all the time:
Your bail was set at $X. Can it actually be lowered?

Bail amounts aren't always final. A judge can sometimes reconsider based on your circumstances.

Posting bail isn't the end of your case, it's what lets you prepare for it outside of custody.

If bail feels out of reach, it's worth understanding your options before assuming there aren't any.

What should you do if you think there's a warrant out for your arrest?

The first step: hire an attorney immediately.

Here’s why walking into court alone is a huge risk:

𝗠𝗶𝘀𝗱𝗲𝗺𝗲𝗮𝗻𝗼𝗿𝘀 & 𝗦𝗼𝗺𝗲 𝗙𝗲𝗹𝗼𝗻𝗶𝗲𝘀: An experienced attorney can often go to court and get the warrant recalled without you even having to appear.

𝗦𝗲𝗿𝗶𝗼𝘂𝘀 𝗙𝗲𝗹𝗼𝗻𝗶𝗲𝘀: While your presence is usually required for major felony warrants, going into court on your own increases the risk of being immediately taken into custody.

Having an attorney by your side during the warrant recall process significantly increases your chances of remaining out of custody.

Something people get wrong about warrants:
They don't go away on their own. Ignoring one doesn't make the problem disappear, it usually just means finding out about it at the worst possible time, like during a traffic stop.

The bigger mistake is trying to handle it alone. How a warrant gets resolved can affect what happens after.

If you find out there's a warrant with your name on it, the first call should be to an attorney, before you decide what to do next.

One thing I tell people all the time:
When you are facing serious felony charges, having a dedicated trial lawyer who is ready to fight for you in court makes all the difference.

We just wrapped up a felony jury trial—facing four felony counts—and secured a complete NOT GUILTY verdict across the board. Hearing our client talk about going home to enjoy his freedom and a sober night is exactly why we do this work.

If you are facing serious charges in Southern California, it's worth having an experienced trial attorney in your corner.

What should you do if a detective calls and asks to talk?

The short answer: don't talk to them.

When a detective calls saying they "just want to hear your side of the story," it usually means an allegation has already been made against you. Their primary goal during this voluntary conversation is to gather statements that can be used to implicate or arrest you.

Instead of answering questions, decline to speak, invoke your Fifth Amendment rights, state that you will only speak with an attorney present, and end the call.

Do you have to open the door if police knock?

The answer depends on whether or not they have a warrant:

If they DO NOT have a warrant: You are under no legal obligation to answer or open the door. Police must obtain a search or arrest warrant to enter your home.

If they DO have a warrant: They have legal authority to enter (and can break down the door if necessary). In this case, you should open the door—but remember, do NOT make any statements or answers questions without an attorney present.

Television shows often make it look like forgetting to read Miranda rights means the entire case gets thrown out instantly. In reality, while a missed warning can mean certain statements made during interrogation cannot be used in court, the core case itself rarely gets dismissed automatically on that ground alone.
