Tenancy Tuesday: The Dark Side of the Eviction Moratorium

A great piece by Jennifer McGraw (), placing a spotlight on some of the homeowner victims due to the laws put in place, without considering the human impact.

Thank you for allowing me to be a part of this piece to discuss the difficulties faced by the Courts.

As we discussed, it's easier to maintain the status quo and later award monetary damages, instead of uprooting individuals. This is the main approach currently being used, without consideration of the fact that some individuals are taking advantage of the laws. Rather than creating equity, the moratorium is creating additional suffering and hardship for the unrepresented and innocent.

This is a prime situation where an innocent family expecting to start their lives in their dream home, experiences the worst possible situation. The family is being forced to put their lives on hold, with limited recourse for when the moratorium is lifted.

To further compound the issue, a select group of individuals are making decisions for the population at large.

Thursday Topics: Student Loans, CDC Moratorium & Evictions

As the eviction moratorium was set to expire, the CDC extended renter protections for another month. Meanwhile, some counties have extended the protections for an extended period of time.

Student Loan payments are set to resume in October, however, there have been proposals to extend the loan forbearance fo several months. If you are burdened with federal student loans, it's important to stay up to date on these proposals.

Tenancy Tuesday: Tenants' Obligations to Comply with the Lease Terms, despite COVID related laws

Although COVID laws are intended as a "shield," there are some Tenants that use the laws as a "sword" seeking to avoid terminating their tenancy. Just to be clear, these unsavory Tenants are not the majority, but they are problematic.

More often than not, I get landlords who wrongly believe they are stuck dealing with these Tenants with no recourse. This is not the case. Landlords and Tenants have ongoing obligations to comply with the terms of the lease. If your tenants are materially breaching the lease, a courtesy notice or a conversation may do the trick. This is a courtesy reminder for all taxpayers that make quarterly estimates. Payments are due on or before June 15.

Managerial Monday: CAL/OSHA's New COVID Workplace Rules

Another week brings another proposed change to the regulations of the workplace. CAL/OSHA is scheduled to approved the guidelines later this week.

The guidelines differ of you are indoors vs. outdoors and whether all members are vaccinated. If working outdoors and unvaccinated, the unvaccinated employee needs to maintain face coverings.

If indoors and all employees are vaccinated, masks are not required. However, if there is a mixture of vaccinated and unvaccinated employees, the guidelines require all employees to wear masks. Taxation Thursday: Pres. Biden's Proposed Tax Hikes and the impact on your business

President Biden laid out some of his budget. Of note, there are proposals for increasing the income tax rate for businesses. Likely, these tax increases will be used in an effort to cover the $1.8 billion dollar programs. Make sure you continue to monitor the proposals and get the business planning you need.
