🚗🌧️ If You Get Hit by a Nice Car, Call Saar!

Rain, flooding, and construction zones can create dangerous driving conditions, especially when visibility is limited and roads become slippery.

What should California drivers know about driving in heavy rain or flooded construction zones?

⚠️ Slow Down: Wet roads can increase stopping distances and make it harder to maintain control of your vehicle.

🚧 Watch for Construction: Lane closures, uneven pavement, construction equipment, and unexpected traffic changes require extra attention.

🌊 Avoid Flooded Roads: Never attempt to drive through standing or moving floodwater when you cannot determine whether it’s safe. Turn around and find another route.

🚘 Keep Your Distance: Leave additional space between your vehicle and the car ahead. Even expensive vehicles aren’t immune to accidents.
Can a driver be held responsible for a car accident during bad weather?

Yes. Rain or flooding doesn’t automatically excuse negligent driving. Under California law, drivers must operate their vehicles at a speed that’s reasonable for the conditions, including weather, visibility, and road conditions.

At Cohn & Swartzon LLP, founding partner Saar Swartzon helps injured Californians understand their rights after car accidents and other collisions involving negligence.

If you’ve been injured in a crash during heavy rain, flooding, or road construction, you can speak with our attorneys about what happened.

📅 What happens if you miss or cancel a medical appointment during a personal injury case?

Life doesn’t stop after an accident. Between work, family responsibilities, and managing injuries, keeping up with medical appointments can be difficult.

In this video, Tiffany Hibbard of Cohn & Swartzon LLP explains why it’s important to communicate with your legal team when you need to cancel or reschedule medical treatment.

⚖️ Can missed medical appointments affect your personal injury claim?

They can. Insurance companies may review gaps in treatment when evaluating your injuries and recovery. Missing appointments doesn’t automatically hurt your case, but unexplained gaps can raise questions.

If you need to cancel an appointment, try to reschedule as soon as possible and let your attorney and paralegal know what happened. If you’re charged a late cancellation fee, save the notice and share it with your legal team.

At Cohn & Swartzon LLP, our attorneys work directly with clients throughout their cases, helping them understand how treatment records and communication can affect their claims.

Part 2: The insurance company can accept fault for a crash and still argue that the crash didn’t cause your injuries.

That’s where causation comes in.

In this video, Cohn & Swartzon LLP Founding Partner Saar Swartzon explains why proving who caused the collision is only part of a personal injury claim. You may also need to show how the collision caused or contributed to the injuries you’re claiming.

Medical records, the timing of treatment, prior medical history, and other evidence can all become part of that discussion.

If an insurance company is questioning whether your injuries are connected to a crash, you don’t have to figure out what that means on your own. Our attorneys can review what happened and explain your options.

The other driver caused the accident. Their insurance knows it. So your injury claim should be straightforward… right?
⠀
Not always.
⠀
Cohn & Swartzon LLP founding partner Saar Swartzon breaks down an important distinction that can catch people by surprise after a California car accident: fault and causation are not the same thing.
⠀
⚖️ Fault asks: Who caused the accident?
⠀
🔎 Causation asks: Did that accident cause the injuries you’re claiming?
⠀
That means an insurance company may accept that its driver caused the crash and still challenge whether the collision caused your injuries.
⠀
And that’s where a claim can get more complicated.
⠀
At Cohn & Swartzon LLP, our clients work directly with a personal injury attorney from the beginning of their case through resolution. We look beyond the question of who caused the accident and examine the evidence surrounding the claim and the injuries.

And Saar isn’t done with this topic.
⠀
This is Part 1 of our Fault vs. Causation series. In Part 2, Saar goes deeper into causation and why an insurance company may dispute an injury claim even when fault for the accident seems clear.
⠀
If you were injured in a California accident and you’re not sure what the insurance company’s position means for your claim, talk to an attorney before making assumptions about your case.

$725,000 Vehicle vs. Pedestrian Settlement ⚖️

Partner Oz Tannenbaum obtained a $725,000 settlement for a client involved in a motor vehicle-versus-pedestrian collision, including a significant contribution directly from the defendant.

What does “contribution” mean in a personal injury case?

In this context, it means a portion of the settlement came directly from the defendant, in addition to other available sources of recovery.

Identifying and negotiating potential sources of recovery can be an important part of resolving a personal injury claim.

Oz brings a unique perspective to those negotiations. Before representing injured plaintiffs, he spent more than 10 years on the insurance defense side. That experience gives him firsthand knowledge of how claims are evaluated, defended, and negotiated from the other side of the table.

Today, Oz uses that experience as a plaintiff attorney and Partner at Cohn & Swartzon LLP, advocating for injured clients throughout California.

Chemical burns can turn an already serious car accident into a much more complicated injury claim.

Founding Partner Saar Swartzon obtained a settlement of nearly $400,000 for a client who suffered chemical burns as a result of a car accident.

Cases involving significant injuries require a careful look at how the injury occurred, the medical evidence, available insurance coverage, and the full impact on the injured person.

If you’ve been seriously injured in an accident and are unsure what your case may involve, contact Cohn & Swartzon LLP for a free consultation.

You watched Oz explain comparative fault. Here’s what that can actually look like after an accident.

Sometimes responsibility isn’t as simple as one person being completely right and the other completely wrong.

Imagine a driver makes an unsafe lane change, but the other driver was speeding.

Or one driver turns left in front of another vehicle, but the approaching driver was distracted and didn’t react as quickly as they otherwise might have.

Or a pedestrian crosses outside of a crosswalk while a driver is also failing to pay proper attention to the road.

In situations like these, there may be questions about whether more than one person contributed to what happened.

California follows a comparative fault system. That means being found partially responsible for an accident does not necessarily mean you have no personal injury claim. Your percentage of responsibility can affect the amount you are ultimately able to recover.

And fault is not always obvious in the moments immediately after an accident. Photos, video, witness statements, vehicle damage, police reports and other evidence can all become important when attorneys evaluate what actually happened.

Think you might have been partially at fault? Don’t make that determination on your own.

Cohn & Swartzon LLP offers free consultations to injured people throughout California. Speak directly with an attorney about what happened and get an assessment based on the facts of your situation.
