Eek! 🎉 Just completed a huge task that has been on my "To-Do List"! I transferred our home into our family trust! 🏡✨ There are so many people to thank like our notary Karin Nielson and our title rep Angeline Ahn who will provide an accommodations recording. It really takes a team to help achieve peace of mind!

As a busy professional and an attorney, it's so easy to prioritize everyone else's needs and forget our own. Today, I treated myself to some self-care with a fresh haircut and color 💇‍♀️ (the grays were calling for attention), tackled some work, and wrapped up by finally securing our family's future with the filing of the proper trust transfer documents.

Start off 2018 preparing for yourself and your family’s needs in case anything happens to you or your spouse. If you have a home and young children, having a trust and an estate plan is critical. Help your family save on taxes, avoid probate, have direction as to who your children should go to if you are not around, etc.

I personally see a lot of clients who have been recently diagnosed with illnesses like cancer (I am seeing more young moms are being diagnosed) or those who have diminished capacity such as dementia. When people wait until something life threatening or tragic happens to establish an estate plan, myself and the clients involved are rushing to have all the documents lined up and signed in time before it’s too late. It can be very stressful because preparing estate documents is a lengthy process. It can take months to complete as it requires a lot of thought and consideration, gathering documents for all assets, communication with all entities involved like your banks, the county of records, etc. I highly recommend having it done now before you are in that situation or even worse, before you pass away. Probate court is not a fun process and can take years for closure.

Shaun, the kids and I went to spend some quality time with one of my legal mentors Herb for his birthday. As we have gotten to know him, we learned that he's been wanting a Heavy Duty 3 Hole Punch since 1998! That's a long time ago!!! So today we gifted him with this mega gift. It's a huge machine!!! It punches 150 pages like butter. As estate planning attorneys, this Hole Punch is essential because we easily fill up our estate planning binders with hundreds of pages per client!!!

This, to me, is every work nerd's dream hehe!!

{ Leaving a Legacy for Your Children } - Trust & Wills

Have you thought about your legacy for your children? It can be how you desire your children to be raised. Do you want your children to understand what it means to work hard and earn a dollar, or do you want your children to be able to backpack through Europe and buy a brand new car when of age? Do you want your child to go to college? These are some differences between being a more conservative parent versus a more liberal parent.

Questions like the above matter if your young children inherit your assets when your time (and your spouse’s time) on earth has come to an end. For your wishes to be known and followed, you’ll need have it documented and the best way is by creating an estate plan.

My name is Katie and I’m a local Orange County mom. I’m an attorney and passionate about what I do in the legal field. { Special Needs Trust - SNT }

This special type of trust allows for a disabled person to maintain his or her eligibility for public assistance benefits, despite having assets that would otherwise make the person ineligible for those benefits. There are different types of SNTs. One type is the third party special needs trusts. They are commonly used by parents planning their estate for a disabled child and their other children.

Public Service Announcement: I've been encountering, more than I would like, clients or friends with lung cancer. So I googled the cause of lung cancer among young Asian female nonsmokers. I came across studies contributing the cause to radon - a non smelling gas that comes from your home. I ordered this kit from Amazon for about $20. You place the kit on the floor of your home for 48 hours and ship it back to the testing center.

What is even more so sad is that when finally diagnosed, these people are at Stage 4! It's because all the symptoms are overlooked for a cold, asthma, cough, bronchitis, etc. It's not until years later that when every option to cure does not work that doctors look into cancer. By then, it's too late. So because I care, I wanted to share. Look into this my friends. It can save your life or the life of someone you love. I would purchase the kit even if you are not female, not Asian, etc.

This also brings up why an estate plan (trust, power of attorney, healthcare directive, will, etc.) is so important to have. (Note: A will may not be enough. California is a trust based state.) I cannot emphasize how important it is to have one done. I tell everyone they need a comprehensive estate plan especially after a diagnosis because I have seen the mess after one's passing or the turmoil once the person becomes incapacitated. It's a stressful situation to leave your family in. A comprehensive plan helps you and your heirs pay substantially less in taxes, fees, and court costs; avoid probate; helps you direct your wishes should you be no longer able to think for yourself; protect your minor beneficiaries; protect your assets from unforseen creditors; etc. It's hard to understand all the benefits when this is a new topic and one is not yet fully informed. It's a learning process especially for the Asian culture because getting a trust is not something we are used to hearing about. My hope is to educate our community about the importance of planning ahead and all the benefits of having one. I am here to help and I genuinely care about what I do.
