Our Firm will be guest speakers this Friday at 12 PM on May 16, 2025 at the West Coast Casualty Construction Defect Seminar held at the Disneyland Hotel. My Law Partner Talin Grigorian and I, along with 2 Defense Attorneys will explore the ramifications of the appeal our firm won last year, Case: Lynch v. Peter & Associates et al whereby the Court of Appeal ruled that the issue of privity is no longer compulsory in finding a design professional liable for negligence and nuisance in construction cases. This landmark ruling impacts the rights of property owners and the liability of design professionals to them.

This past year our firm won two significant appellate cases. One case, Lynch v. Peters & Associates was published by the Court of Appeals, 4th District 3rd Div. It significantly altered current case law by holding that design professionals in hashtag and hashtag cases may be held liable to property owners notwithstanding the lack of privity between them. Holding design professionals, in this instance engineers, liable to Parties with whom there is no privity or contractual relationship may extend even further to other third Parties, including contractors. It clearly distinguishes the prior relied upon case of Weseloh Family Trust v. KL Wessel Construction and provides further protection for property owners and their rights. Case link as follows:
