Important update for individuals affected by the pause in immigration benefit adjudications. A federal court in Rhode Island has ordered USCIS to resume processing applications that had been placed on hold for nationals of 39 designated countries. This ruling reinforces the principle that immigration applications must be adjudicated in accordance with the law and may provide renewed opportunities for many applicants who have been left in limbo. If you believe your case may be affected by this decision, consult with experienced immigration counsel to understand your rights and options.

Today marks an important victory for fairness and due process in our immigration system. A federal judge in Rhode Island ruled that the Administration’s policy of indefinitely pausing the adjudication of immigration benefits for individuals from 39 designated countries was unlawful and ordered USCIS to resume processing those applications. The court found that applicants should not be left in legal limbo simply because of their country of birth and reaffirmed that immigration agencies must follow the law and treat individuals equally under established legal procedures. This decision offers renewed hope to thousands of immigrants and families whose cases have been delayed for months while awaiting lawful adjudication. 🇺🇸🇺🇸

Did you know that you may be eligible to obtain a work permit in the United States even if you do not currently have lawful immigration status?

Many individuals with pending immigration cases can qualify for Employment Authorization Documents (EADs), including those with pending asylum applications, certain cases before the Immigration Court, and other immigration benefits authorized by law. In many situations, you do not need to wait until your case is fully approved to apply for work authorization.

Every case is different, and eligibility depends on the specific type of immigration application or proceeding involved. If you are unsure whether you qualify for a work permit, consult with a qualified immigration attorney to evaluate your options.

🚨 USCIS Adjustment of Status Update 🚨

Following widespread concern over the recent USCIS policy memorandum on Adjustment of Status (Form I-485), the Department of Homeland Security has now clarified that most green card applicants will NOT be required to leave the United States while their applications are pending. While the May 2026 memorandum emphasizing discretionary review remains in effect, today’s clarification suggests that adjustment of status remains available for many eligible applicants. As implementation continues to evolve, applicants should seek individualized legal advice before making any immigration decisions. Stay tuned! 🇺🇸

Questions that are being asked by USCIS officers now in connection to adjustment of status interviews:

Why are you applying for adjustment of status in the United States?”
* Officers may be testing whether the applicant intentionally used a temporary visa as a shortcut to permanent residence.
* They may also be evaluating whether there are equities favoring adjustment here.
2. “Why didn’t you pursue consular processing?”
* This goes directly to the memo’s emphasis that consular processing is supposedly the normal route.
3. “What would prevent you from returning to your country for consular processing?”
* Officers may be looking for humanitarian concerns, unlawful presence bars, safety concerns, family separation issues, medical hardship, inability to re-enter, political danger, or employment disruption.
4. “Do you still have family or support systems in your home country?”
* This may relate to whether consular processing would truly create hardship or whether the applicant maintains strong ties abroad.

Many lawful permanent residents (green card holders) do not realize that remaining outside of the United States for extended periods of time without a reentry permit can create serious issues when returning to the U.S. A reentry permit helps show that you intended to maintain your permanent resident status while temporarily living or traveling abroad and can help avoid allegations that you abandoned your residency. Always consult with an experienced immigration attorney before long-term international travel.

⚠️ Important USCIS Update ⚠️

USCIS has issued new policy guidance directing officers to apply heightened scrutiny and enhanced vetting when reviewing Adjustment of Status (green card) applications. This means that even applicants who may otherwise qualify could now face increased review, discretionary analysis, delays, requests for additional evidence, or denials.

In today’s immigration climate, it is more important than ever to have experienced legal counsel properly prepare and review your case before filing. A small mistake, inconsistency, or overlooked issue can now have much more serious consequences. If you are considering filing for a green card or already have a pending case, consult with a qualified immigration attorney to protect your future and ensure your application is strategically prepared.
