Tenants facing eviction now have ten days to respond to a complaint, not five. The change, signed into law in September, was not opposed by the state’s central landlord lobby, the California Apartment Association. However, landlords could go another five days with unpaid rent or another situation that led to the eviction filing.

If you have questions about the eviction process and how to make it go as smoothly as possible, AWB Law PC can help!

Your ability to enter an occupied unit is restricted. Tenants not only pay for a right to occupy a space but, within limits, to enjoy it. That includes the ability to be left alone. Their rights to the unit conflict with your rights to protect and maintain it, and state law tries to reach a compromise between the parties. You also shouldn’t ask about or seek personal information.

If you have questions about your tenants’ privacy rights and how to prevent violating them, call the AWB Law PC team at (949) 244-4207 or complete our online contact form today. We can discuss the situation, how state laws may apply, and how you should handle the issue.

When you can remove a vehicle from your property is discussed in the state’s vehicle code. As a whole, the legislature tried to balance the interests of vehicle and property owners. You may face financial consequences if you’re too zealous with towing vehicles.

If you’re responsible for a vehicle to be towed from your property, the owner may be angry and upset with you. The person could be a random stranger who wanted to park off the street, a tenant, their friend, or a family member.

As you know, California is car-dependent and, given your location, may be the main or only means of transportation. Add to this possibly bad situation the owner’s alcohol or drug use, you may be in a potentially dangerous situation. When in doubt for your safety, call the police.

If you have questions about towing vehicles or any other issue concerning your property, call the AWB Law PC team at (949) 244-4207 . We can discuss your situation, how state laws may apply, and how you should best proceed.

Are Residential Landlords Required to Accommodate Disabled Tenants?

State and federal laws cover housing discrimination and those with disabilities. Depending on the nature of the disability and the requested accommodation, you may be legally required to provide it. Your obligation to accommodate the tenant has limits, so you may not need to do what they ask, but you should try to work out a compromise that meets their needs without being an undue burden for you.

Are you a residential landlord with questions about accommodating a tenant with a disability or need representation in a matter involving one? Call the AWB Law, P.C. team at (949) 244-4207 or complete our online contact form today. We can advise you on protecting your rights and ensuring your actions comply with applicable laws and city ordinances.

My Tenant, The Hoarder

Landlords want to avoid many issues, like bad plumbing, a leaky roof, or a tenant whose Harley-Davidson needs a muffler. Add to the list a tenant who hoards possessions (maybe even pets) to the point the unit is unsafe, unsanitary, and creates problems for other tenants. You can be proactive to lessen this risk or address the issue before it becomes a crisis.

Disputes are bound to come up in any business relationship. Each tenant and landlord has their own approach to resolving differences, and how well they work varies depending on the issue and the person involved. If severe enough, a dispute may result in some legal action, but that’s an expensive and time-consuming approach you should try to avoid.
