If your naturalization application is denied by a USCIS officer, you may request a hearing at which a different officer will review your case and consider additional evidence you wish to submit. If your application is again denied, you may file a petition with the U.S. District Court, asking that a judge give your application fresh consideration. In some cases, it may make more sense to file a new naturalization application, rather than appeal a denial. An immigration lawyer can help you decide the best option in your situation.

Visas come in two main types—immigrant and nonimmigrant. An immigrant visa is for people who wish to live permanently in the United States, with a green card. Nonimmigrant visas are for those who only wish to stay in the U.S. on a temporary basis, for purposes such as work, tourism or study. An immigration attorney can help you decide the best visa for your situation and advise you about the necessary petitions and applications.

In 2022, the Biden administration launched an initiative that provides a pathway back to the U.S. for non-citizen veterans deported for non-violent crimes. At least 75 deported veterans have returned under the Biden initiative, according to the Department of Homeland Security.

Some non-U.S. citizen veterans who were deported over non-violent crimes say there needs to be reform.
