Is pleading guilty the same as being convicted? ⚖️

Not exactly, but the distinction is important.

In Indiana, entering a guilty plea generally leads to a judgment of conviction, which the court typically enters at or before sentencing. However, certain deferral programs may allow eligible individuals to avoid a conviction if specific conditions are met.

Before accepting a plea agreement, it's important to understand the potential consequences and whether other legal options may be available.

“I'm innocent, so I don't need a lawyer.”

Unfortunately, it's not always that simple.

Even if you've done nothing wrong, criminal charges don't automatically disappear. Evidence must be evaluated, court procedures followed, and deadlines met.

An attorney can help identify potential weaknesses in the prosecution's case, challenge evidence, and protect your rights throughout the process.

Your criminal case was dismissed. Does that mean your record is clear?

Not necessarily!

When a case is dismissed, the charges are dropped, but the record of your arrest, court proceedings, and dismissal may still be publicly accessible.

Expungement is a separate legal process that can provide additional protections. In Indiana, eligible records may be sealed from public access or marked as expunged, depending on the type of offense.

Indiana law also provides protections against certain forms of discrimination based on expunged arrests and convictions, including in employment, education, and professional licensing.

If your case was dismissed but still appears on your record, expungement may be worth exploring.

Have questions about your eligibility? Contact Brinkley Law to learn more about your options.

Before signing a business contract, it's worth taking a closer look at what you're actually agreeing to.

Payment deadlines, cancellation provisions, and each party's responsibilities can all affect how a business relationship plays out.

When these terms are unclear or missing, disagreements can become more difficult to resolve.

Taking time to review an agreement before signing can help you better understand your obligations and identify potential risks.

Brinkley Law assists Indiana business owners with drafting, reviewing, and negotiating business agreements.

A Level 6 felony is the lowest felony classification in Indiana, but that doesn't mean the consequences are minor.

Under Indiana law, a Level 6 felony carries a sentencing range of six months to two and a half years, with an advisory sentence of one year and a possible fine of up to $10,000.

However, the outcome isn't necessarily the same for everyone. Depending on the circumstances, a court may suspend part or all of the sentence, and certain cases may qualify for misdemeanor treatment.

Understanding the charge and your legal options is an important first step.

Have questions about a Level 6 felony charge? Contact Brinkley Law to discuss your situation.
