Although never planned, divorce is a complication of life that affects many. What happens if your Will leaves everything to your now ex-spouse because you never changed the Will after a divorce? When you pass away, will your ex-spouse still get your assets?
Maintaining control of your estate includes making sure your assets go where you want them to go after you pass. This should be done with a written estate plan, including a Will or trust.
However, circumstances almost always change between the time you create a Will and the time of your passing. When those changes alter who you want to receive your assets, or the way you want them to receive those assets, it is critical that you change your Will or trust as soon as you can. If you create a Will but do not periodically review it, you may have an estate document, but you do not have an effective estate plan. An out-of-date estate document may actually undermine your estate plan. Learn more on what you can do to be prepared.

I occasionally meet with people who have chosen to transfer their home to someone else while they are still alive. They do this by signing the deed to their home over to a child, spouse or someone else. When the deed is signed over, that home - in many cases, the most expensive asset that person owns - is now completely in the control of someone else.
When I ask why they choose to give their home to someone else, I am often told that they believe it is an effective way to qualify for Medicaid assistance if they need long term care. I recognize that the circumstances for each family are unique. However, I have yet to advise a client it is a good idea to give their home to someone else while they are still alive.
When people transfer their home in order to qualify for Medicaid long term care assistance, they are setting themselves up for a double “whammy.” Learn about how to protect yourself and your future.

People sometimes deed their property to their children while still alive in order to make sure the home goes to the kids after the parent has passed. However, this shortcut often comes with significant unanticipated risks/costs.
When a homeowner dies, the home usually must go through a process called “probate” to be passed on to the person entitled to receive it. Signing over the deed while still alive is supposed to avoid probate.
When a parent deeds the home to a child in this way, the assumption is that the parent will pass first. Of course, this is not always true. Learn more how you can be best prepared for yours and your family's future.

When counseling clients about estate planning, my primary objective is to help them maintain control of their estate. This includes helping clients ensure that, on their passing, their assets go to those they want to receive them. This result does not happen automatically.
Take the example of a man with children from a prior relationship who purchases a home with his girlfriend. Both his name and his girlfriend’s name are on the deed to the home and on the loan. When he dies, what will he have to pass on and to whom?
