LinkedIn just reminded me — it’s been 5 years since I officially opened my law firm.

What many don’t know is that my firm’s original name was Legacy Legal Consulting.

I launched the business before registering the name. But when I finally went to file it in Maryland, I discovered a Texas law firm had already registered Legacy Legal Consulting.

So… my firm became Legacy Legal & Consulting Firm instead.

Here’s the lesson:

👉🏽 Registering your business name is NOT the same as owning your trademark.

A state business registry might let you add a word or symbol to make your name unique for registration purposes…

but the USPTO will likely reject your trademark application if your name is confusingly similar to another brand in your industry.

That’s why adding a random word or symbol isn’t a brand strategy — it’s a bandage.

Can I share a secret? 🤫

Sometimes, adding the right word to a similar brand name can secure trademark rights.

That’s not a bandage — that’s brand strategy.

On Monday, I was pi**ed. I mean it was a “everybody can get it day.”

I was fed up with an examiner being non-responsive.

Last month, my client’s trademark received an office action. The 3 month clock started ticking. 1 month and still no response from the examiner.

See the examiner made a mistake. One I didn’t want coming back to hurt my client.

So I was pi**ed… and called the supervisor.

Within 6 hours, I received a call. Within the next few hours, the examiner made note to move my client’s application to the next step.

See while my clients are growing their business and expanding… they had no clue about the office action or the examiner ignoring my emails and voicemail.
